Labor Disputes. No labor disturbance by or dispute with employees of the Company exists or, to the knowledge of the Company, is threatened which would be reasonably likely to have a Material Adverse Effect.

No Labor Disputes. No Loan Party is involved in any labor dispute; there are no strikes or walkouts or union organization of any Loan Party’s employees threatened, to its knowledge, or in existence and no labor contract is scheduled to expire during the Term other than as set forth on [Schedule 5.14] hereto.

Set forth on [Schedule 8.13] to the Information Certificate is a list (including dates of termination) of all collective bargaining or similar agreements between or applicable to each Borrower and Guarantor and any union, labor organization or other bargaining agent in respect of the employees of any Borrower or Guarantor on the date of Amendment No. 4.

No Borrower is currently subject to any materially adverse labor dispute, strike or walkout and, to the best of each Borrower’s knowledge, none have been threatened in writing; to the best of each Borrower’s knowledge, there is no effort underway to organize a labor union of any of such Borrower’s employees; and no labor contract is scheduled to expire during the Term other than as set forth in [Schedule 5.14] hereto.

Neither the Company nor any of its subsidiaries has received any notice of cancellation or termination with respect to any collective bargaining agreement to which it is a party.
