ADEA Release contract clause examples

ADEA Release. You acknowledge that you are knowingly and voluntarily waiving and releasing any rights you have under the ADEA, and that the consideration given for the waiver and releases you have given in this Agreement is in addition to anything of value to which you were already entitled. You further acknowledge that you have been advised, as required by the ADEA, that: # your waiver and release does not apply to any rights or claims that arise after the date you sign this Agreement; # you should consult with an attorney prior to signing this Agreement (although you may choose voluntarily not to do so); # you have twenty- one (21) days to consider this Agreement (although you may choose voluntarily to sign it sooner); # you have seven (7) days following the date you sign this Agreement to revoke this Agreement (in a written revocation sent to me); and # this Agreement will not be effective until the date upon which the revocation period has expired, which will be the eighth day after you sign this Agreement provided that you do not revoke it (the “Effective Date”).

ADEA Release. ADEA Waiver and Release. Among the claims being released by Employee in this Agreement are claims under the Age Discrimination in Employment Act of 1967, as amended (“ADEA”), 29 U.S.C. [Sections 621-34]4]. Pursuant to and in compliance with the Older Workers Benefit Protection Act, 29 U.S.C. Section 626(f), Employee acknowledges that:

ADEA Release. Executive hereby completely and forever releases and irrevocably discharges the Released Parties, from any and all Claims arising under the Age Discrimination in Employment Act (“ADEA”) on or before the date Executive signs this Release Agreement (the “ADEA Release”), and hereby acknowledges and agrees that: # this Release Agreement, including the ADEA Release, was negotiated at arm’s length; # this Release Agreement, including the ADEA Release, is worded in a manner that Executive fully understands; # Executive specifically waives any rights or claims under the ADEA; # Executive knowingly and voluntarily agrees to all of the terms set forth in this Release Agreement, including the ADEA Release; # Executive acknowledges and understands that any Claims under the ADEA that may arise after the date of this Release Agreement are not waived; # the rights and claims waived in this Release Agreement, including the ADEA Release, are in exchange for consideration over and above anything to which Executive was already entitled; # Executive has been and hereby is advised in writing to consult with an attorney prior to executing the Release Agreement, including the ADEA Release; # Executive acknowledges that he has been given a period of up to twenty-one (21) days from receipt of this Release Agreement to consider the ADEA Release prior to executing it and acknowledges and agrees that any discussions between Executive and the Company concerning the terms of this Release Agreement and/or any change in the terms of this Release Agreement after the date that Executive first receives this Release Agreement shall not affect or restart such twenty-one (21) day consideration period; and # Executive understands that he has been given a period of seven (7) days from the date of the execution of this Release Agreement to revoke the ADEA Release, and understands and acknowledges
