Tenants Access Rights. Landlord hereby agrees to permit Tenant access, at Tenants sole risk and expense, to the Building # 45 days prior to the Commencement Date to perform any work (“Tenants Work”) required by Tenant other than Landlords Work, provided that such Tenants Work is coordinated with the TI Architect and the general contractor, and complies with the Lease and all other reasonable restrictions and conditions Landlord may impose, and # prior to the completion of Landlords Work, to inspect and observe work in process; all such access shall be during normal business hours or at such other times as are reasonably designated by Landlord. Notwithstanding the foregoing, Tenant shall have no right to enter onto the Premises or the Project unless and until Tenant shall deliver to Landlord evidence reasonably satisfactory to Landlord demonstrating that any insurance reasonably required by Landlord in connection with such pre-commencement access (including, but not limited to, any insurance that Landlord may require pursuant to the Lease) is in full force and effect. Any entry by Tenant shall comply with all established safety practices of Landlords contractor and Landlord until completion of Landlords Work and acceptance thereof by Tenant.

Tenants Access. Subject to such reasonable rules and regulations as Landlord may impose from time to time, and causes beyond Landlords reasonable control, Tenant shall have the right, during the Term of the Lease, to have access to the Premises, twenty-four hours per day, seven days per week. Any rules, regulations, mechanisms or procedures of Landlord with respect to controlling or regulating access to the Premises, the Building or other portions of the Property shall not be interpreted as imposing any duty on the Landlord to provide security for the Premises, the Building or any portion of the Property or any person in the Premises, the Building or elsewhere on the Property.

Tenants Access Rights. Landlord hereby agrees to permit Tenant, Tenants Representatives, and any of Tenants architects, engineers, and/or contractors access, at Tenants sole risk and expense, to the Building prior to the Turnover Condition Date, to inspect and observe the Base Building Work in process; all such access shall be during normal business hours or at such other times as are reasonably designated or approved by Landlord. Notwithstanding the foregoing, Tenant, Tenants Representatives, and any of Tenants architects, engineers, and/or contractors shall have no right to enter onto the Premises or the Building unless and until Tenant shall deliver to Landlord evidence reasonably satisfactory to Landlord demonstrating that any insurance that Landlord may require pursuant to the Lease is in full force and effect. Any entry by Tenant, Tenants Representatives, and any of Tenants architects, engineers, and/or contractors shall comply with all reasonable and established safety practices of Landlords contractor and Landlord until completion of the Base Building Work and acceptance thereof by Tenant.

Tenants Access. From and after the Term Commencement Date and until the end of the Term and any extension thereof, Tenant shall have access to the Premises twenty-four (24) hours a day, seven (7) days a week, subject to Landlords reasonable Building security requirements, causes beyond Landlords reasonable control, Legal Requirements, the Rules and Regulations, the terms of this Lease, Force Majeure (hereinafter defined) and matters of record.

Tenants Access Rights. Landlord hereby agrees to permit Tenant access, at Tenants sole risk and expense, # to Suite 1 for a period of 30 days prior to the Suite 1 Commencement Date and to Suites 2-4 for a period of 30 days prior to the Suites 2-4 Commencement Date to perform any work (“Tenants Work”) required by Tenant other than the Tenant Improvements, provided that such Tenants Work is coordinated with the TI Architect and the general contractor, and complies with the Lease and all other reasonable restrictions and conditions Landlord may impose, and # prior to the completion of the Tenant Improvements, to inspect and observe work in process. In addition, Landlord hereby agrees to permit Tenant access, at Tenants sole risk and expense, to Suite 5 for a period of 30 days prior to the Suite 5 Commencement Date to perform any Tenants Work required by Tenant in Suite 5 other than the Warm Shell Improvements, provided that such Tenants Work in Suite 5 is coordinated with the TI Architect and the general contractor, and complies with the Lease and all other reasonable restrictions and conditions Landlord may impose. All access by Tenant permitted under this [Section 6(a)] shall be during normal business hours or at such other times as are reasonably designated by Landlord. Notwithstanding the foregoing, Tenant shall have no right to enter onto the Premises or the Project unless and until Tenant shall deliver to Landlord evidence reasonably satisfactory to Landlord demonstrating that any insurance reasonably required by Landlord in connection with such pre-commencement access (including, but not limited to, any insurance that Landlord may require pursuant to the Lease) is in full force and effect. Any entry by Tenant shall comply with all established safety practices of Landlords contractor and Landlord until completion of Landlords Work and acceptance thereof by Tenant.

Tenants Access Rights. Landlord hereby agrees to permit Tenant access, at Tenants sole risk and expense, to the Building # 14 days prior to the Commencement Date to perform any work (“Tenants Work”) required by Tenant other than Landlords Work, provided that such Tenants Work is coordinated with the TI Architect and the general contractor, and complies with the Lease and all other reasonable restrictions and conditions Landlord may impose, and # prior to the completion of Landlord's Work, to inspect and observe work in process; all such access shall be during normal business hours or at such other times as are reasonably designated by Landlord. Notwithstanding the foregoing, Tenant shall have no right to enter onto the Premises or the Project unless and until Tenant shall deliver to Landlord evidence reasonably satisfactory to Landlord demonstrating that any Insurance reasonably required by Landlord in connection with such pre-commencement access (including, but not limited to, any insurance that Landlord may require pursuant to the Lease) is in full force and effect. Any entry by Tenant shall comply with all established safety practices of Landlords contractor and Landlord until completion of Landlords Work and acceptance thereof by Tenant.

Tenants Access. Tenant and its employees shall have reasonable access to the Premises 24 hours per day, 7 days per week (and access to such portions of the Building as required in order to access the Premises on a 24 hour per day, 7 day per week basis), except due to any Force Majeure Cause (as described in Section 28.7 below) or emergencies preventing such access.

Tenants Early Access. Provided that Tenant and its agents do not interfere with any of the Tenant Improvement work in the Building and the Premises, Tenant may access the Premises at any time prior to the Lease Commencement Date to install equipment and fixtures (including Tenants data and telephone equipment) in the Premises, and to otherwise prepare the Premises for occupancy. All of such access rights are subject to the following limitations: # prior to any entry, Tenant shall comply with all of the insurance provisions in this Lease, including delivering applicable Certificates of Insurance to Landlord which name Landlord as an additional insured; # any early entry shall be at the sole risk of Tenant, including, but not limited to theft, bodily injury, vandalism or other damage; # Tenant shall strictly comply with all requirements of Landlord and Landlords contractor concerning Tenants early entry into the Premises; and # Tenant shall hold Landlord harmless from and indemnify, protect and defend Landlord against any loss or damage to the Building or Premises and against injury to any persons or property damage caused by Tenants actions pursuant to this Section. Tenant shall have no obligation to pay Base Rent or Direct Expenses during such early occupancy period; provided, however, if Tenant commences business operations in any portion of the Premises before the Lease Commencement Date, then # such early occupancy period shall automatically end and # the Lease Commencement Date shall be advanced to occur on the date Tenant commences such business operations, notwithstanding any other provision in this Lease to the contrary.

Tenants Access Rights. Landlord hereby agrees to permit Tenant (including Tenants Representative and Tenants Project Manager) access, at Tenants sole risk and expense, to the Third Expansion Premises # 60 days prior to the Third Expansion Premises Commencement Date to perform any data cabling work and 30 days prior to the Third Expansion Premises Commencement Date to perform any other work (such data cabling and other work, “Tenants Work”) required by Tenant other than Landlords Work, provided that such Tenants Work is coordinated with the TI Architect and the general contractor, and complies with the Lease and all other reasonable restrictions and conditions Landlord may impose, and # prior to the completion of Landlords Work, to, at Tenants election and not as an obligation, inspect and observe work in process to determine, in Tenants estimation, if Landlords Work proceeding in accordance with the TI Construction Drawings, the TI Permit and the schedule; all such access shall be during normal business hours or at such other times as are reasonably designated by Landlord. Any entry by Tenant shall comply with all established safety practices of Landlords contractor and Landlord until completion of Landlords Work and acceptance thereof by Tenant.

Provided no event of Tenant default has occurred and the Tenant does not interfere with the rights of other tenants or the Tenant Improvements, Tenant will be allowed, upon reasonable notice and approval of Landlord, reasonable access to the Premises up to thirty (30) days prior to the Commencement Date to permit Tenant to install fixtures, furniture, and equipment to allow for a transition into the Premises. During such access, Tenant shall be bound by all of the obligations of Tenant under the Lease, including any and all insurance requirements, but, provided that said access is solely for the purpose of installing fixtures, furniture, and equipment to allow for a transition into the Premises and not for the operation of Tenants business, excluding the payment of Fixed Rent and Tenants proportionate share of Taxes and Operating Expenses during the above-mentioned early access period.
