Storage. [[Unknown Identifier]] Intermediate Batches and Polysaccharide Intermediate Batches (required intermediates for the production of Conjugate Drug Substances) will be stored ​ until the [[Unknown Identifier]] Intermediate Batches and Polysaccharide Intermediate Batches are used for the manufacturing of Conjugate Drug Substances; ​.

TPI shall deliver the finished Components to the Storage Yard in shipping fixtures provided by GEII that are capable of appropriately transporting the Components from the Production Facility to the Storage Yard. GEII shall provide shipping fixtures to the Storage Yard. TPI shall be responsible for transfer of the shipping fixtures to the Production Facility for the loading and transportation of the blades to the Storage Yard. TPI shall be responsible for the proper care of the shipping fixtures, and all unloading of trailers at the Storage Yard. All damages or losses at the Storage Yard, including without limitation, the Components shall be borne by TPI, and TPI shall be responsible for insuring against risk of loss or damage at the Storage Yard. The parties understand that TPI shall have no obligation to provide any storage of finished Components at the Production Facility.

Crestwood Storage, Inc. is properly treated as an association taxable as a corporation for U.S. federal income tax purposes. Crestwood Storage, Inc. is not, and has never been # a “controlled foreign corporation” within the meaning of Section 957 of the Code and the Treasury Regulations promulgated thereunder, or # a “passive foreign investment company” within the meaning of Section 1297 of the Code and the Treasury Regulations promulgated thereunder.

Groundwater Storage Scheduling. By September 1 of each year, PEF may elect to store in Groundwater Storage any amount of the Annual Volume or Additional Supply purchased for that particular year that has not been delivered to Pastoria. By way of example, if PEF committed in its Annual Volume Scheduling Notice to purchase 2,800 AF of Tejon Water and, as of September 1, 2,000 AF had been delivered to Pastoria, PEF could schedule storage of up to 800 AF in Groundwater Storage.

Landlord and Storage Agreements. Upon request, provide Agent with copies of all existing agreements, and promptly after execution thereof, provide Agent with copies of all future written agreements, between a Borrower and any landlord, warehouseman, processor, shipper, bailee or other Person that, individually or collectively, owns any premises at which any Collateral in excess of $5,000,000 in the aggregate may be kept or that otherwise may possess or handle any Collateral.

Groundwater Storage and Recovery Payments. PEF shall pay “Groundwater Storage and Recovery Payments” of $125 per AF of Tejon Water delivered to Groundwater Storage when elected by PEF. Payments under this Section 7.3 shall cover the storage and recovery of the Tejon Water in Groundwater Storage and its delivery to Pastoria from Groundwater Storage. The Annual Option Payment (discussed in Section 7.1 above) will be credited to Groundwater Storage and Recovery Payments.

Use and Storage of Dedicated Equipment. Provider shall use and store the Dedicated Equipment in accordance with any written instructions prescribed by or the manufacturer of the Dedicated Equipment, and shall performed such routine maintenance and storage for the Dedicated Equipment in accordance with such written instructions at Provider’s expense as set forth in a Work Order. The parties acknowledge that Tenant has inspected the Substitute Storage Space and the Building and is fully familiar with the physical condition thereof and Tenant agrees to accept the Substitute Storage Space at the Substitute Storage Space Commencement Date in its then “as is” condition. Tenant acknowledges and agrees that Landlord shall have no obligation to do any work in or to the Substitute Space in order to make it suitable and ready for occupancy and use by Tenant except to the extent expressly provided for in this Article 3.

Bike Storage: Landlord shall provide and maintain a secured bicycle storage facility in the Parking Facility (the “Bike Storage Facility”). Tenant shall be entitled to utilize Tenant’s Proportionate Share of such Bike Storage Facility. Tenant and its employees shall use the Bike Storage Facility at its own risk and will provide such reasonable certifications of waiver of liability as Landlord may reasonably request from time to time. Without limiting the generality of the foregoing, each user of the Bike Storage Facility shall be required to execute and deliver a waiver of liability in a form to be provided by Landlord and reasonably acceptable to Tenant (provided that no such waiver shall apply to the gross negligence or willful misconduct of Landlord and/or Landlord’s Representatives).

Firm Storage Contract” means an agreement pursuant to which the provides firm gas storage services pursuant to its tariff on file with the CPUC.

Earnout Period” means the period beginning on the Closing Date and concluding on the end of the third Gas Storage Year following the Initial Gas Storage Year.

Calculation Periods” means # that portion of the Initial Gas Storage Year commencing on the Closing Date, and # each of the following three (3) Gas Storage Years, respectively, thereafter.

Tenant shall continue to pay annual fixed rent, additional rent, escalations and other charges for the Substitute Storage Space from the Substitute Storage Space Commencement Date through the Expiration Date at the rates and under the conditions set forth in the Lease, as modified by the Ninth Amendment, but shall have no obligations or liabilities accruing from and after the Substitute Storage Space Commencement Date with respect to the Storage Space which shall no longer be a part of the Premises.

“Midstream Activities” means the gathering, compression, transportation, storage, or transmission of natural gas, including constructing, owning, maintaining, and operating gathering systems, pipelines, storage facilities and other assets related thereto.

# Self Storage II LLC, a New York limited liability company ("TSS II"), is the owner of the parcel of real property which is operated and used as a one hundred forty-one (141) unit self-storage facility in Millbrook, New York, as more fully described on [Exhibit B-SS]S] (the "New York Self Storage Property).

Seller will deliver the finished Components to the Storage Facility in, if appropriate, shipping cradles provided by Buyer that are capable of appropriately transporting the Components from the Production Facility to the Storage Facility. If required, shipping cradles will be delivered by Buyer to the Production Facility or Storage Facility at the instruction of Seller and stored at either the Production Facility or the Storage Facility at Seller’s discretion. If required, storage cradles will be provided and maintained by Seller. Seller will be responsible for the proper care and regular maintenance of the shipping and storage cradles and, subject to payment as discussed herein, for all loading and unloading of trailers at the Storage Facility. Buyer will be responsible for obtaining all export and import licenses, permits and approvals as may be required for transport from the People’s Republic of China to the country of destination. All damages or losses at the Storage Facility will be born by Seller, and Seller will be responsible for insuring against the risk of loss or damage at the Storage Facility. Buyer will be responsible for the delivery of the Components to the wind farm sites of its customers. Seller shall be responsible for the loading of Components into trailers for transport to the wind farm sites of Buyer’s customers.

Landlord shall, at its sole cost and expense, (i) prepare the Substitute Storage Space in substantially the same condition as the Storage Space, and (ii) relocate all of Tenant’s property.

If underground or other storage tanks storing Hazardous Materials installed or utilized by Tenant are located on the Premises, or are hereafter placed on the Premises by Tenant (or by any other party, if such storage tanks are utilized by Tenant), then Tenant shall monitor the storage tanks, maintain appropriate records, implement reporting procedures, properly close any underground storage tanks, and take or cause to be taken all other steps necessary or required under the Applicable Laws. Tenant shall have no responsibility or liability for underground or other storage tanks installed by anyone other than Tenant unless Tenant utilizes such tanks, in which case Tenant’s responsibility for such tanks shall be as set forth in this Section.
