the Material made available by Novartis will only be used according to any applicable specifications, especially release specifications, and in accordance with Laws and after delivery to [[Party:Organization]] thereof Novartis will have no further obligation to replace lost or damaged Material or to provide additional services with respect to such Material.

Items are free from defects in workmanship and material, substantially conform to all samples, drawings, descriptions, and specifications furnished or published in non-draft form by Supplier, and to any other agreed-to specifications, and the sole remedy for a breach of this warranty as stated in Paragraph C of this Section;

# Gatherer and Processor shall not be obligated to receive, gather and/or process (as the case may be), the Subject Gas delivered hereunder that fails to meet # the quality specifications of any Downstream Transporter at any of the Residue Gas Delivery Point(s) or Plant Products Delivery Point(s), or # the following specifications:

Tenant, in its discretion, may install window coverings for exterior windows per Landlord’s specifications.

To supply to the Landlord and the Superior Landlord all plans and specifications the Landlord and/or the Superior Landlord may reasonably require to identify any proposed works and to carry out all works only in accordance with such approved plans and specifications and to the reasonable satisfaction of the Landlord and the Superior Landlord;

Architectural drawings, plans and specifications and site plans for each Property including, without limitation, any drawings, plans and specifications related to the prospective development of the Millbrook Expansion (collectively, the "Plans"), to be made available to Purchaser at the location where they are kept in the ordinary course of business, to the extent available;

and codes and # complete all such construction and development in accordance with approved plans and specifications.

Ability to Supply. During the Term, SELLER shall commit to supply Product that meets the Specifications.

“Plans and Specifications” shall mean all plans and specifications, shop drawings, architectural and engineering reports and designs, together with all architectural and engineering agreements, construction contracts and other material agreements entered into by [[Borrower:Organization]] or prepared by [[Borrower:Organization]]’s Architect and the Other Design Professionals, in connection with the Total Project Related Costs in accordance with the Project Budget.
