Confidentiality and Return of Company Property. In accordance with the terms of his/her Employment Agreement, Employee understands and agrees that as a condition of receiving the Severance Package in paragraph 1, all Company property must be returned to Company. By signing this Agreement, Employee represents and warrants that Employee has returned to Company, all Company property, data and information belonging to Company and agrees that Employee will not use or disclose to others any confidential or proprietary information of Company or the Released Parties. In addition, Employee agrees to keep the terms of this Agreement confidential between Employee and Company, except that Employee may tell Employee’s immediate family and attorney or accountant, if any, as needed, but in no event should Employee discuss this Agreement or its terms with any current or prospective employee of Company.

Confidentiality and Return of the Company Property. Executive understands and agrees that as a condition of receiving the Severance Package, all Company property must be returned to the Company on or before the separation date or within a reasonable time thereafter. By signing this General Release, Executive represents and warrants that Executive has returned to the Company on or before the Executive's execution of this General Release, all Company property, data and information belonging to the Company and agrees that Executive will not use or disclose to others any confidential or proprietary information of the Company or the Released Parties. In addition, Executive agrees to keep the terms of the Severance Package confidential between Executive and the Company, except that Executive may tell Executive’s immediate family and attorney or accountant, if any, as needed, but in no event should Executive discuss the Severance Package or its terms with any current or prospective employee of the Company.
