Receivable File contract clause examples

Eligible Receivable” means a Domestic Eligible Receivable or an EXIM Eligible Receivable.

Branch Receivable” means a Small Branch Receivable or a Large Branch Receivable.

Principal Balance” means, as of any determination date with respect to # a Receivable or Managed Portfolio Receivable other than a Precompute Receivable, the outstanding principal balance of such Receivable or Managed Portfolio Receivable and # a Receivable or Managed Portfolio Receivable that is a Precompute Receivable, the calculated principal balance of such Precompute Receivable, which is the result of # the remaining unpaid amount due in respect of such Precompute Receivable minus # the unearned interest on such Precompute Receivable calculated on an accrual basis; provided, that in the case of (a) and (b), the principal balance of such Receivable or Managed Portfolio Receivable is measured as of the most recent Determination Date (or as of such date of determination if such date is a Determination Date), or with respect to any Receivables transferred to the Borrower after such Determination Date, as of the related Cutoff Date, provided, that the Principal Balance of any Receivable or Managed Portfolio Receivable, a portion of which has been charged‑off in accordance with the Collection Policy, shall be reduced by the portion so charged‑off; provided, further, the Principal Balance of any Receivable that becomes a “Defaulted Receivable” will be deemed to be zero as of the date it becomes a “Defaulted Receivable” and the Principal Balance of any Managed Portfolio Receivable that becomes a “Managed Portfolio Defaulted Receivable” will be deemed to be zero as of the date it becomes a “Managed Portfolio Defaulted Receivable”.

at the time of origination of such Receivable, such Receivable had an amount financed of at least $300 and no more than # $5,000 if such Receivable is a Convenience Check, # $25,000 if such Receivable is a Hard Secured Receivable, or #

any Receivable represented by the Borrower to be an Eligible Receivable which is not at the applicable time, an Eligible Receivable;

Accounts Receivable. BUTTE has no accounts receivable.

Eligible Receivable” means, at any time, any Receivable:

it is not owing by an Accounts Receivable Debtor with respect to which twenty-five percent (25%) or more of the aggregate Accounts Receivable owing by such Accounts Receivable Debtor to Borrower are not Eligible Accounts Receivable for any reason; and

"Outstanding Amount" means at any time in respect of any Receivable or Purchased Receivable, the total amount due and owing by the relevant Permitted Obligor at that time in respect of the relevant Receivable or Purchased Receivable. For the avoidance of doubt, the Outstanding Amount for any Purchased Receivable shall not be reduced by virtue of any set off or counterclaim which reduces the amount recoverable in respect of that Purchased Receivable.

Managed Portfolio Receivable” means a Receivable (without giving effect to the requirement in the definition thereof that the related Contract be included in the Schedule of Receivables hereto) in [[Servicer:Organization]]’s loan portfolio with an APR of 36% or less that relates to a Large Branch Receivable, Small Branch Receivable, Convenience Check or Online Originated Receivable, except for # auto loan delinquent renewals and # any identified test products.
