Property Insurance. Landlord agrees to maintain property insurance insuring the Building against damage or destruction due to risk including fire, vandalism, and malicious mischief in an amount not less than the replacement cost thereof, in the form and with deductibles and endorsements as selected by Landlord. At its election, Landlord may instead (but shall have no obligation to) obtain “All Risk” coverage, and may also obtain earthquake, pollution, and/or flood insurance in amounts selected by Landlord.

Tenant's Compliance With Landlord's Property Insurance. Landlord agrees to maintainshall insure the Building during the Lease Term against loss or damage under an "all risk" property insurance insuringpolicy. Such coverage shall be in such amounts, from such companies, and on such other terms and conditions, as Landlord may from time to time reasonably determine. Additionally, at the option of Landlord, such insurance coverage may include the risks of earthquakes and/or flood damage and additional hazards, a rental loss endorsement and one or more loss payee endorsements in favor of the holders of any mortgages or deeds of trust encumbering the interest of Landlord in the Building against damage or destruction duethe ground or underlying lessors of the Building, or any portion thereof. Tenant shall, at Tenant's expense, comply with all insurance company requirements pertaining to risk including fire, vandalism, and malicious mischief in an amountthe use of the Premises, provided that such requirements do not lessprevent Tenant's use of the Premises for the Permitted Use. If Tenant's conduct or use of the Premises (other than the replacement cost thereof,Permitted Use) causes any increase in the formpremium for such insurance policies then Tenant shall reimburse Landlord for any such increase. Tenant, at Tenant's expense, shall comply with all rules, orders, regulations or requirements of the American Insurance Association (formerly the National Board of Fire Underwriters) and with deductiblesany similar body. Tenant shall also provide Landlord and endorsementsLandlord’s insurer(s) with such information regarding the use of the Premises and any damage to the Premises as selected by Landlord. At its election, Landlordthey may instead (but shall have no obligation to) obtain “All Risk” coverage, and may also obtain earthquake, pollution, and/require in connection with the placement of insurance for the Premises or flood insurance in amounts selected by Landlord. the adjusting of any losses to the Premises.

Landlord agrees to maintainshall insure the Building, Tenant Improvements and any Alterations during the Lease Term against loss or damage under an "all risk" property insurance insuringpolicy. Such coverage shall be in such amounts, from such companies, and on such other terms and conditions, as Landlord may from time to time reasonably determine. Additionally, at the option of Landlord, such insurance coverage may include the risks of earthquakes and/or flood damage and additional hazards, a rental loss endorsement and one or more loss payee endorsements in favor of the holders of any mortgages or deeds of trust encumbering the interest of Landlord in the Building against damage or destructionthe ground or underlying lessors of the Building, or any portion thereof. Notwithstanding anything to the contrary in this Lease, Tenant shall not be required to comply with or cause the Premises to comply with any laws, rules, regulations or insurance requirements requiring the construction of alterations unless such compliance is necessitated solely due to risk including fire, vandalism, and malicious mischief in an amount not less thanTenant's particular use of the replacement cost thereof, in the form and with deductibles and endorsements as selected by Landlord. At its election, Landlord may instead (but shall have no obligation to) obtain “All Risk” coverage, and may also obtain earthquake, pollution, and/or flood insurance in amounts selected by Landlord.Premises.

Property Insurance. Landlord agrees toshall maintain property insurance insuringfor the Building against damageand the Project in amounts equal to full replacement cost (exclusive of the costs of excavation, foundations and footings, engineering costs or destruction duesuch other costs to risk including fire, vandalism,the extent the same are not incurred in the event of a rebuild and malicious mischief in an amountwithout reference to depreciation taken by Landlord upon its books or tax returns) or such lesser coverage as Landlord may elect, provided that such coverage shall not be less than the replacement costamount of such insurance Landlord’s Lender, if any, requires Landlord to maintain, providing protection against any peril generally included within the classification “Fire and Extended Coverage,” together with insurance against sprinkler damage (if applicable), vandalism and malicious mischief. Landlord, subject to availability thereof, shall further insure, if Landlord deems it appropriate, coverage against flood, environmental hazard, earthquake, loss or failure of building equipment, rental loss during the period of repairs or rebuilding, Workers’ Compensation insurance and fidelity bonds for employees employed to perform services. Notwithstanding the foregoing, Landlord may, but shall not be deemed required to, provide insurance for any improvements installed by Tenant or that are in addition to the form and with deductibles and endorsements as selectedstandard improvements customarily furnished by Landlord. At its election, Landlord may instead (but shall have no obligation to) obtain “All Risk” coverage, and may also obtain earthquake, pollution, and/Landlord, without regard to whether or flood insurance in amounts selected by Landlord. not such are made a part of or are affixed to the Building.
