Pronouns; Including. Wherever appropriate in this Agreement, personal pronouns shall be deemed to include the other genders and the singular to include the plural. Wherever used in this Agreement, the term "including" means "including, without limitation."

Including. The word “including” or any variation thereof means “including, without limitation” and shall not be construed to limit any general statement that it follows to the specific or similar items or matters immediately following it.

Pronouns. Masculine pronouns and other words of masculine gender shall refer to both men and women.

Pronouns. Whenever used in this Plan, the masculine pronoun is to be deemed to include the feminine. The singular form, whenever used herein, shall mean or include the plural form where applicable, and vice versa.

Enforcement of Agreement Patents (Including Joint Patents). As between the Parties, Allergan shall have the sole right, but not the obligation, to prosecute any alleged or threatened infringement with respect to Agreement Patents solely owned or Controlled by Allergan, including as a defense or counterclaim in connection with any Third Party Infringement Claim, at Allergan’s sole cost and expense, using counsel of its own choice, and Allergan shall retain control of the prosecution of such suit. The Parties shall mutually agree upon which Party shall enforce Joint Patents, based on the contribution of each Party and each Party’s potential interest in products based upon the Joint Inventions Covered by such Joint Patents.
