Default Rate. If Tenant fails to make any payment to any third party or to do any act herein required to be made or done by Tenant, then Landlord may, after written notice to Tenant and continued failure by Tenant to make any such required payment within five (5) days, but shall not be required to, make such payment or do such act. However, notwithstanding the foregoing, with respect failures by Tenant to make those repairs required of Tenant hereunder, Landlord shall refrain from making such repairs on Tenant’s behalf except in accordance with Section 8.1 hereof. The taking of such action by Landlord shall not be considered a cure of such default by Tenant or prevent Landlord from pursuing any remedy it is otherwise entitled to in connection with such default. If Landlord elects to make such payment or do such act, then all reasonable expenses actually incurred by Landlord, plus interest thereon at a rate (the “Default Rate”) equal to lesser of # the rate per annum which is five (5) whole percentage points higher than the Prime Rate from the date incurred by Landlord, or # the maximum rate then allowed by applicable Law, to the date of payment thereof by Tenant, which shall constitute additional rent due hereunder.

Default Rate. In the event that, and for so long as, any Event of Default shall have occurred and be continuing, the Outstanding Principal Balance and, to the extent permitted by law, all accrued and unpaid interest in respect of the Loan and any other amounts due pursuant to the Loan Documents, shall accrue interest at the Default Rate until the cure of the applicable Event of Default, calculated from the date such payment was due without regard to any grace or cure periods contained herein.

Default Rate. To the extent permitted by Law, immediately upon the occurrence and during the continuation of an Event of Default under [clause (g) or (h) of Section 9.1], or immediately after written demand by the Requisite [[Organization A:Organization]] to the Administrative Agent after the occurrence and during the continuation of an Event of Default under [clause (a) of Section 9.1], then the principal amount of all Obligations shall bear interest at the Default Rate. The Borrower acknowledges that the increase in rates referred to in this Section 3.4(b) reflects, among other things, the fact that such Term Loans or other amounts have become a substantially greater risk given their default status and that the [[Organization A:Organization]] are entitled to additional compensation for such risk; and all such interest shall be payable by the Borrower upon demand by the Administrative Agent.

Default Rate. Immediately upon the occurrence and during the continuance of an Event of Default, Obligations shall bear interest at a rate per annum which is five percent (5.0%) above the rate that is otherwise applicable thereto (the “Default Rate”), unless Bank otherwise elects from time to time in its sole discretion to impose a smaller increase. Fees and expenses which are required to be paid by Borrower pursuant to the Loan Documents (including, without limitation, Bank Expenses) but are not paid when due shall bear interest until paid at a rate equal to the highest rate applicable to the Obligations. Payment or acceptance of the increased interest rate provided in this Section 2.3(b) is not a permitted alternative to timely payment and shall not constitute a waiver of any Event of Default or otherwise prejudice or limit any rights or remedies of Bank.

Default Rate. After the occurrence and during the continuance of a Default described in [Section 8.1(B)] or, at the option of the Administrative Agent or at the direction of Required Lenders, after the occurrence and during the continuance of any other Default, the interest rate(s) applicable to the Obligations shall be equal to the then applicable rate plus two percent (2.0%) per annum, and the fee described in Section 3.8(A) shall be equal to the then Applicable L/C Fee Percentage plus two percent (2.0%) per annum.

Default Rate. If a Participant fails to designate one or more Crediting Rate Alternatives to be used to measure income, gains and losses with respect to amounts credited to his or her Account, such amounts will be deemed to be invested in a default Crediting Rate Alternative designated by the Plan Administrator in accordance with Plan Rules.

Default Rate. Immediately upon the occurrence and during the continuance of an Event of Default, Obligations under the Term Loan shall bear interest at the Growth Capital Default Rate as defined in and in accordance with [Section 2.1.2(f)].

If any amount of principal of any Loan is not paid when due (without regard to any applicable grace periods), whether at stated maturity, by acceleration or otherwise, then upon the request of the Required such amount shall thereafter bear interest at a fluctuating interest rate per annum at all times equal to the Default Rate to the fullest extent permitted by applicable Laws.

Post-Default Allocation Notwithstanding anything in any Loan Document to the contrary, during an Event of Default, monies to be applied to the Obligations, whether arising from payments by Borrowers, realization on Collateral, setoff or otherwise, shall be allocated as follows:

No Conversion Post-Default or Post-Unmatured Default. Notwithstanding anything to the contrary contained in [Section 2.9(A) or 2.9(B)])], no Advance may be converted into or continued as a Eurocurrency Rate Advance (except with the consent of the Required Lenders) when any Default or Unmatured Default has occurred and is continuing.
