Investments in connection with the Transactions;

Investments (including equity Investments) in Strategic Joint Ventures in an aggregate amount not to exceed $75,000,000; and

Investments (excluding Acquisitions but including Investments in Subsidiaries) not otherwise permitted by this Section 6.04 so long as the Payment Conditions are satisfied before and immediately after giving effect to each such Investment and so long as no such Investment requires the incurrence of any Indebtedness, contingent obligation (including any capital call) or other liability not otherwise permitted under this Agreement by any Loan Party or otherwise enables a creditor to have recourse to any Loan Party not otherwise permitted under this Agreement;

Guarantees constituting Indebtedness permitted by [Section 7.1];

loans or advances to employees, officers and directors to the extent permitted in [Section 7.5(c)];

Guarantees constituting Indebtedness permitted by [Section 7.1];

the Secured Obligations;

Investments (including debt obligations) received in connection with the bankruptcy or reorganization of account debtors, suppliers and customers and in settlement of delinquent obligations of, and other disputes with, account debtors, customers and suppliers arising in the ordinary course of business;

Hedge Agreements entered into in the ordinary course of business and not for speculative purposes;

Investments received in connection with the bankruptcy or reorganization of, or settlement of delinquent accounts and disputes with or judgments against, customers and suppliers, in each case in the ordinary course of business;
