the Secured Obligations;

Investments in negotiable instruments deposited or to be deposited for collection in the ordinary course of business;

the RDS Intercompany Loan; and

loans and investments in connection with a Permitted Accounts Receivable Program;

the granting of Permitted Liens and Permitted Licenses;

Investments consisting of stock, obligations, securities or other property received in settlement of accounts receivable (created in the ordinary course of business[[Borrower:Organization]] from bankrupt obligors;

Investments in connection with the Transactions;

any Loan Party or Subsidiary may form or create a new Subsidiary provided that all actions required under Section 5.14 with respect to such formation or creation shall have been taken;

Investments resulting from entering into # Interest Rate Hedges and Foreign Currency Hedges incurred for the bona fide purpose of hedging the interest rate, commodity or foreign currency risks associated with the operations of the Companies and not for speculative purposes or Cash Management Products and Services, or # agreements relative to Indebtedness that is permitted under clause (i) of the definition of “Permitted Indebtedness”;

Investments (including debt obligations) received in connection with the bankruptcy or reorganization of account debtors, suppliers and customers and in settlement of delinquent obligations of, and other disputes with, account debtors, customers and suppliers arising in the ordinary course of business;
