Investments not otherwise permitted by the foregoing provisions of this [Section 6.08] in an aggregate amount in an aggregate amount for all such Investments under this clause (g) not to exceed the greater of # $100,000,000 and # 10% of Total Assets;

Investments by any Foreign Subsidiary in another Foreign Subsidiary;

Permitted Acquisitions. Notwithstanding Section 5.1(a), Sibelco and its Representatives and Affiliates shall not be prohibited from acquiring any Common Stock:

Investments resulting from entering into # Interest Rate Hedges and Foreign Currency Hedges incurred for the bona fide purpose of hedging the interest rate, commodity or foreign currency risks associated with the operations of the Companies and not for speculative purposes or Cash Management Products and Services, or # agreements relative to Indebtedness that is permitted under clause (i) of the definition of “Permitted Indebtedness”;

Investments in connection with the Transactions;

the Secured Obligations;

Investments (including equity Investments) in Strategic Joint Ventures in an aggregate amount not to exceed $75,000,000; and

Investments (including debt obligations) received in connection with the bankruptcy or reorganization of account debtors, suppliers and customers and in settlement of delinquent obligations of, and other disputes with, account debtors, customers and suppliers arising in the ordinary course of business;
