together with all other Protective Advances then outstanding, shall not # exceed tenthe greater of five percent (105%) of the Modified Borrowing Base and $20,000,000 at any time or # unless a Liquidation is taking place, remain outstanding for more than forty-five (45) consecutive Business Days, unless in each case, the Requisite Revolving Credit Lenders and the [[FILO Documentation Agent:Organization]] otherwise agree;
