Lost or Mutilated Note. If this Note shall be mutilated, lost, stolen or destroyed, the [[Organization A:Organization]] shall execute and deliver, in exchange and substitution for and upon cancellation of a mutilated Note, or in lieu of or in substitution for a lost, stolen or destroyed Note, a new Note for the principal amount of this Note so mutilated, lost, stolen or destroyed, but only upon receipt of evidence of such loss, theft or destruction of this Note, and of the ownership hereof, reasonably satisfactory to the [[Organization A:Organization]].

Lost, Stolen or Mutilated Note. Upon receipt by the Company of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Note, and, in the case of loss, theft or destruction, of any indemnification undertaking by the Holder to the Company in customary form and, in the case of mutilation, upon surrender and cancellation of this Note, the Company shall execute and deliver to the Holder a new Note.

Lost or Mutilated Debenture. If this Debenture shall be mutilated, lost, stolen or destroyed, [[the Company:Organization]] shall execute and deliver, in exchange and substitution for and upon cancellation of a mutilated Debenture, or in lieu of or in substitution for a lost, stolen or destroyed Debenture, a new Debenture for the principal amount of this Debenture so mutilated, lost, stolen or destroyed, but only upon receipt of evidence of such loss, theft or destruction of such Debenture, and of the ownership hereof, reasonably satisfactory to [[the Company:Organization]].

the at their own expense shall execute and deliver within five Business Days, in lieu thereof, a new Note, dated and bearing interest from the date to which interest shall have been paid on such lost, stolen, destroyed or mutilated Note or dated the date of such lost, stolen, destroyed or mutilated Note if no interest shall have been paid thereon.

Lost Warrants. Upon receipt of evidence reasonably satisfactory to [[Organization A:Organization]] of the loss, theft, destruction, or mutilation of this Warrant and, in the case of any such loss, theft or destruction, upon receipt of an indemnity reasonably satisfactory to [[Organization A:Organization]], or in the case of any such mutilation upon surrender and cancellation of such Warrant, [[Organization A:Organization]], at its expense, will make and deliver a new Warrant, of like tenor, in lieu of the lost, stolen, destroyed or mutilated Warrant.

Lost Certificate. Upon receipt by the Company of evidence satisfactory to it of the loss, theft, destruction or mutilation of this Purchase Warrant and of reasonably satisfactory indemnification or the posting of a bond, the Company shall execute and deliver a new Purchase Warrant of like tenor and date. Any such new Purchase Warrant executed and delivered as a result of such loss, theft, mutilation or destruction shall constitute a substitute contractual obligation on the part of the Company.

Lost Certificates. If any Certificate shall have been lost, stolen or destroyed, upon the making of an affidavit of that fact by the person claiming such Certificate to be lost, stolen or destroyed, the Exchange Agent shall issue in exchange for such lost, stolen or destroyed Certificate the Merger Consideration deliverable in respect thereof pursuant to this Agreement.

Note. If requested, each [[Organization C:Organization]] that so requests shall have received Notes duly executed and delivered by an authorized officer of the Applicant Borrower;

Note. The Note (if same is requested by the [[Organization B:Organization]]) shall have been duly executed and delivered by the [[Organization A:Organization]] to [l],, as the sole [[Organization B:Organization]] on the Effective Date.

The original Mortgage Note together with any applicable riders, endorsed in blank by original signature, with all prior and intervening endorsements as may be necessary to show a complete chain of endorsements. In the event the original Mortgage Note has been lost, an original lost note affidavit may be in place of the Mortgage Note. In all instances, a copy of the original Mortgage Note must accompany the original lost note affidavit;
