Limited Condition Transactions. Notwithstanding anything to the contrary herein, in the event that the Borrower provides written notice to the Administrative Agent designating a proposed transaction as a Limited Condition Transaction and indicating the Borrower’s intention to test the conditions to such Limited Condition Transaction and the availability of the Incremental Term Facility that is to be used to finance such Limited Condition Transaction in accordance with this Section, then the following provisions shall apply:
SECTION # Limited Condition Acquisitions. In the event that a Borrower notifies the Administrative Agent in writing that any proposed Permitted Acquisition is a Limited Condition Acquisition and that such Borrower wishes to test the conditions to such Limited Condition Acquisition and the availability of Incremental Term Loans that is to be used to finance such Limited Condition Acquisition in accordance with this Section, then, so long as agreed to by the Administrative Agent and the lenders providing such Incremental Term Loans, the following provisions shall apply:
Section # Limited Conditionality Acquisitions. In the event that the Company notifies the Administrative Agent in writing that any proposed Acquisition is a Limited Conditionality Acquisition and that the Company wishes to test the conditions to such Acquisition and the availability of the Incremental Term Loans to be used to finance such Acquisition in accordance with this Section, then the following provisions shall apply:
