Furniture, Fixtures and Equipment. Subtenant shall have the right to use during the Term the furnishings within the Subleased Premises and the Shared Area that are identified on Exhibit C attached hereto (the “Furniture”) at no additional cost to Subtenant. The Furniture is provided in its “AS IS, WHERE IS” condition, without representation or warranty whatsoever. Subtenant shall insure the Furniture under the property insurance policy required under the Master Lease, as incorporated herein, and pay all taxes with respect to the Furniture. Subtenant shall maintain the Furniture in good condition and repair, reasonable wear and tear excepted, and shall be responsible for any loss or damage to the same occurring during the Term. Subtenant shall surrender the Furniture to Sublandlord upon the termination of this Sublease in the same condition as exists as of the Commencement Date, reasonable wear and tear excepted. Subtenant shall not remove any of the Furniture from the Subleased Premises.

No Fixtures. It is the intention of the parties hereto that (except for Collateral located on real estate owned in fee simple by any Grantor that is mortgaged to the Administrative Agent pursuant to a Mortgage or Collateral located on real estate for which the landlord with respect thereto executes and delivers to the Administrative Agent a landlord waiver and consent in form and substance reasonably acceptable to the Administrative Agent) none of the Collateral shall become Fixtures, and the Grantors will take all such action or actions as may be necessary to prevent any of the Collateral from becoming Fixtures, which actions may include the Grantors obtaining waivers of Liens, in form satisfactory to the Administrative Agent, from each lessor of real property on which any of the Collateral is or is to be located to the extent requested by the Administrative Agent.

Equipment. All machinery, equipment, tools, dies, molds, parts, furniture and other tangible personal property included in the Purchased Assets whether or not reflected in the Unaudited Business Financial Statements, is in good operating condition and repair, ordinary wear and tear excepted.

Equipment. In the event special, custom, or Customer-dedicated equipment (the “Dedicated Equipment”) is to be acquired by WuXi ATU for the manufacture of Product such acquisition in a Work Order and:

All furniture, trade fixtures and equipment (other than equipment that constitutes fixtures), personal property of any Seller, and all inventory, in each case located on the Properties.

Removal of Fixtures. Tenant may, prior to the expiration of the Lease Term, remove all fixtures and equipment which Tenant has placed on the Leased Property, provided Tenant repairs all damage to the Leased Property caused by such removal; provided, however, Tenant shall not remove, under any circumstances, the following: heating, ventilating, air conditioning, plumbing, electrical and lighting systems and fixtures or dock levelers.

All machinery, fixtures, and equipment used in the business;

Landlord shall provide reasonably sufficient electricity to the Premises (including adequate electrical wiring and facilities for connection to Tenant's lighting fixtures and incidental use equipment), provided that the connected electrical load of Tenant's lighting fixtures and the incidental use equipment does not, in the aggregate, exceed the connected electrical loads typically required at First Class Life Sciences Projects. Tenant will design Tenant's electrical system serving any equipment producing nonlinear electrical loads to accommodate such nonlinear

the equipment, fixtures, machinery, tanks, flow lines, pipelines, gathering lines, saltwater disposal facilities, pumping units, gauges, meters, casing, rods and separation facilities, generators, compressors and compression equipment and facilities, production facilities, and all other personal property or fixtures located on or used in connection with the Leases and Lands or used in connection with the production, gathering, treatment, processing, storing, transportation, sale or disposal of hydrocarbons from the Lands or Leases (the “Equipment”);
