No one, including your Employer or any other person, may fire you or otherwise discriminate against you in any way to prevent you from obtaining a benefit under this Plan or from exercising your rights under ERISA.

If, prior to the Closing, the Improvements on any of the Properties are destroyed or damaged by fire, other casualty or any act or occurrence (“Casualty”), Sellers shall notify Purchaser thereof promptly after Sellers become aware thereof.

Keep the personal property, fixtures and equipment of the Business reasonably insured against damage by fire and other casualty, in an amount equal to its highest insurable value, with replacement cost endorsement, as an expense of the Business.

Landlord shall maintain fire and extended coverage in an amount adequate to cover 90% of the cost of replacement of the Building. Landlord shall also carry public liability and property damage insurance as required by its fee mortgage.

Copies of all written notices received by Seller or any Operating Company after the Effective Date from any governmental authority of any material violations of zoning, safety, building, fire, environmental or health code relating to each Property; and

In the event of any fire or casualty during the last two (2) years of the initial Term, or during the last year of an Extension Period (as hereinafter defined), and # the same renders more than one-third of the Premises unusable or inaccessible for general office use and the same cannot reasonably be expected to be ready for re-occupancy for such use within one-half of the remaining Lease Term or Extension Period, and # Tenant shall not have validly exercised a remaining Extension Option (as hereinafter defined) for the next Extension Period prior to the occurrence of such fire or casualty; or
