Any Claimant who receives an Adverse Benefit Determination or who has not received a response within sixty (60) days may request a review by notice given in writing to the claim, upon review, is denied in whole or in part, the Plan Administrator shall notify the claimant of the adverse benefit determinationAdministrator. Such request must be made within sixty (60) days after receipt by the Claimant of suchthe written notice of Adverse Benefit Determination, or in the event Claimant has not received a response sixty (60) days after receipt by the Administrator of Claimant's claim or request. The claim or request shall be reviewed by the Administrator which may, but shall not be required to, grant the Claimant a hearing. On review, the Claimant may have representation, examine pertinent documents, and submit issues and comments in writing relating to the claim for reviewbenefits.

Claim on Review If a claim is wholly or partially denied, the claim, upon review, is denied in whole or in part, the Plan Administratorplan administrator shall notify the claimant of the plan's adverse benefit determination within sixty (60)a reasonable period of time, but not later than 90 days after receipt of the claim by the plan, unless the plan administrator determines that special circumstances require an extension of time for processing the claim. If the plan administrator determines that an extension of time for processing is required, written notice of the extension shall be furnished to the claimant prior to the termination of the initial 90‑day period. In no event shall such extension exceed a request for reviewperiod of 90 days from the end of such initial period. The extension notice shall indicate the special circumstances requiring an extension of time and the date by which the plan expects to render the benefit determination.

Claim on Review IfRequest for Review. Within sixty (60) days after receipt of an initial adverse benefit determination notice, the claim, upon review, is denied in whole or in part,claimant may file with the Plan Administrator shall notify the claimanta written request for a review of the adverse benefit determination and may, in connection therewith submit written comments, documents, records and other information relating to the claim benefits. Any request for review of the initial adverse determination not filed within sixty (60) days after receipt of such a request for reviewthe initial adverse determination notice shall be untimely.

Claim on Review If the claim, upon review, is denied in wholeClaimant does not agree with the Administrator’s decision, the Claimant can request that the Administrator reconsider his or in part, the Plan Administrator shall notify the claimant of the adverse benefit determinationher decision by filing a written request for review within sixty (60) days after receipt of suchreceiving notice that the claim has been denied. The Claimant or the Claimant’s representative can also present written statements which explain why the Claimant believes that the benefit claimed should be paid and may review all pertinent plan documents. Generally, the appealed decision will be reviewed within sixty (60) days after the Administrator receives a request for reconsideration. However, if special circumstances require a delay, the review may take up to one hundred twenty (120) days. (If a decision cannot be made within the 60-day period, the Claimant will be notified of this fact in writing.) The Claimant will receive a written notice of the decision which will explain the reasons for the decision by making specific reference to the Plan provisions on which the decision is based.

Claim on Review IfThe Plan Administrator shall render a determination upon the claim, uponappealed claim which determination shall be accompanied by a written statement as to the reasons therefore. The determination shall be communicated to the Claimant within 60 days of the Claimant’s request for review, is denied in whole or in part,unless the Plan Administrator determines that special circumstances require an extension of time for processing the claim. In such case, the Plan Administrator shall notify the claimantClaimant of the need for an extension of time to render its decision prior to the end of the initial 60-day period, and the Plan Administrator shall have an additional 60-day period to make its determination. The determination so rendered shall be binding upon all parties. If the determination is adverse benefitto the Claimant, the notice shall: # provide the reason or reasons for denial; # make specific reference to the Plan provisions on which the determination within sixty (60) days after receiptwas based; # include a statement that the Claimant is entitled to receive, upon request and free of such a requestcharge, reasonable access to, and copies of, all documents, records and other information relevant to the Claimant’s claim for reviewbenefits; and # state that the Claimant has the right to bring an action under [section 502(a)] of ERISA.
