The Committee shall within 60 days, # maydays thereafter review the claim and authorize the claimant to appear personally and review pertinent Plan documents and # may submit issues and comments relating to the claim to the persons responsible for making the determination on behalf of the Committee. The Committee will render its final decision with specific reasons therefor and in writing.a manner calculated to be understood by the claimant, and will transmit it to the claimant within 60 days of the written request for review. If the Committee fails to respond to a claim is denied because of incomplete information,filed in accordance with the notice shall also indicate what additional information is required. If additional time is required to make a decision on the claim,foregoing within 60 days, the Committee shall notifybe deemed to have denied the claimantclaim. This [Section 7.5] shall not serve to prohibit any Participant from bringing an action in a court of competent jurisdiction to enforce his rights under the delay within the original 90 day period. This extension period may not exceed 90 days beyond the end of the first 90-day period.

If such an extension of time for review is required because of special circumstances, written notice within 90 daysof the extension shall be furnished to the person claimingapplicant before the benefits that containscommencement of the extension. Notice of such final determination of the Committee shall be furnished to the applicant in writing, in a manner calculated to be understood by him, and shall set forth the specific reasons for the denial,decision and specific references to the pertinent provisions of the Plan provisions on which the Committee based its denial and a statement thatdecision is based. If the claimant may # request a review upon written application to the Committee within 60 days, # may review pertinent Plan documents and # may submit issues and comments in writing.
