If the Committee determines that a Participant or Beneficiary entitled to receive a payment under this Plan is (at the time such payment is to be made) a minor or physically, mentally or legally incompetent to receive such payment and that another person or an institution has legal custody of such minor or incompetent individual, the Committee may cause payment to be made to such person or institution having custody of such Participant or Beneficiary. Such payment, to the extent made, shall operate as a complete discharge of obligation by the Committee, the Company, the Trustee and the Trust.
IfIn the Committee determines thatevent a Participant or Beneficiary entitled to receive a payment under this Plan is (at the time such payment is to be made)made to the account of a minor or physically, mentally or legally incompetenta person declared to receive such payment and that another person or an institution has legal custody of such minor or incompetent individual,be incompetent, then the Committee may causein its discretion make such payment to be madethe legal guardian or, if none, to such person or institution having custodya parent of such Participant or Beneficiary.a minor with whom the minor maintains his residence. Such payment,a payment to the extent made,legal guardian or parent of a minor shall operate asfully discharge the Company and Committee from further liability or account thereof In the event a complete discharge of obligation bybenefit is payable under this Plan to a person who cannot be located, the Committee, the Company, the Trustee and the Trust.Committee may declare that such payment is forfeited.
If the Committee determinesshall find that a Participant or Beneficiary entitledany person to receive a paymentwhom any amount is payable under this Plan is (atunable to care for his affairs because of illness or accident, or is a minor, any payment due (unless a prior claim therefor shall have been made by a duly appointed guardian, committee or other legal representative) may be paid to the timespouse, a child, a parent, or a brother or sister, or to any person deemed by the Committee to have incurred expense for such payment isperson otherwise entitled to be made) a minor or physically, mentally or legally incompetent to receivepayment, in such paymentmanner and that another person or an institution has legal custody of such minor or incompetent individual,proportions as the Committee may causedetermine. The Committee may require proof of minority, incompetence, incapacity or guardianship, as it may deem appropriate prior to distribution of the benefit. Any such payment toshall be made to such person or institution having custody of such Participant or Beneficiary. Such payment, to the extent made, shall operate as a complete discharge of obligation by the Committee,liabilities of the Company, the Trustee and the Trust.Company under this Plan.
Alternative Payees in Event of Incapacity. If the Committee determinesfinds at any time that a Participant or Beneficiary entitled to receive a paymentan individual qualifying for benefits under this Plan is (at the time such payment is to be made) a minor or physically, mentally or legally incompetent to receive such payment and that another person or an institution has legal custody of such minor or incompetent individual,is incompetent, the Committee may cause paymentdirect the benefits to be madepaid, in the case of a minor, to his or her parents, his or her legal guardian, or a custodian for him under the Uniform Gifts to Minors Act, or, in the case of an incompetent, to his or her spouse, or his or her legal guardian, the payments to be used for the individual’s benefit. The Committee and the Trustee shall not be obligated to inquire as to the actual use of the funds by the person receiving them under this Section 12.10, and any such person or institution having custodypayment shall completely discharge the obligations of such Participant or Beneficiary. Such payment,the Plan, the Trustee, the Committee, and the Employers to the extent made, shall operate as a complete discharge of obligation by the Committee, the Company, the Trustee and the Trust.payment.
16.15Incompetent. If the Committee determines in its discretion that a Participant or Beneficiary entitled to receive a paymentbenefit under this Plan is (at the time such payment is to be made)paid to a minorminor, a person declared incompetent or physically, mentallyto a person incapable of handling the disposition of that person’s property, the Committee may direct payment of such benefit to the guardian, legal representative or legally incompetent to receive such paymentperson having the care and that another person or an institution has legal custody of such minorminor, incompetent or incompetent individual, theincapable person. The Committee may causerequire proof of minority, incompetence, incapacity or guardianship, as it may deem appropriate prior to distribution of the benefit. Any payment toof a benefit shall be made to such person or institution having custodya payment for the account of suchthe Participant or Beneficiary. Such payment, toand the extent made,Participant’s Beneficiary, as the case may be, and shall operate asbe a complete discharge of obligation byany liability under the Committee, the Company, the Trustee and the Trust.Plan for such payment amount.
Facility of Payments. If the Committee determines that a Participant or Beneficiaryany person entitled to receive a payment under thisthe Plan is (at the time such payment is to be made) a minorphysically or physically, mentally or legally incompetent to receive such payment, the Committee shall direct the payment and that another personto the legal guardian or an institution has legal custodyother personal representative of such minor or incompetent individual,person for the use and benefit of such person. If the Committee for any reason is unable to determine with reasonable certainty the proper person to pay pursuant to the immediately preceding sentence, the Committee may cause paymentdirect that any amounts due hereunder be paid into a court of competent jurisdiction in an interpleader proceeding for purposes of being directed by such court as to be made to such person or institution having custodythe proper disposition of such Participant or Beneficiary. Such payment, to the extent made,amounts. Any such payment shall operate asbe a full and complete discharge of any liability or obligation byunder the Committee, the Company, the Trustee and the Trust.Plan.
