Extension Right. For the avoidance of doubt, Tenant’s Extension Right under [Section 39] of the Lease (as amended by the Second Amendment) shall remain in effect with respect to the remaining Premises.

Extension Right. Tenant shall have 1 right (the “Extension Right”) to extend the term of the Lease for 5 years (the “Extension Term”) on the same terms and conditions as the Lease (other than with respect to Base Rent, the Work Letter, the Second Expansion Premises Work Letter and the Third Expansion Premises Work Letter) by giving Landlord written notice of its election to exercise the Extension Right at least 12 months prior to the expiration of the Base Term of the Lease.

Extension Right. Subject to the terms of Section 39(g) below, Tenant shall have 1 right (the “Extension Right”) to extend the term of this Lease for 2 years (the “Extension Term”) on the same terms and conditions as this Lease (other than with respect to Base Rent) by giving Landlord written notice of its election to exercise the Extension Right at least 15 months prior and not more than 18 months prior to the expiration of the Base Term of the Lease.

Extension Right. Tenant shall have the one-time right (the “Extension Right”) to extend the term of this Lease for 5 years (the “Extension Term”) on the same terms and conditions as this Lease (other than with respect to Base Rent and the Work Letter) by giving Landlord written notice of its election to exercise such Extension Right (an “Exercise Notice”) at least 12 months and not more than 15 months prior to the expiration of the Base Term of this Lease. Within 30 days after Tenant’s delivery to Landlord of a written request therefor, which request shall be delivered prior to Tenant’s delivery of an Exercise Notice but not more than 17 months prior to the expiration of the Base Term of the Lease, Landlord shall provide Tenant with Landlord’s determination of the Market Rate and escalations that would be applicable during the Extension Term.

Extension Right. Tenant shall have 1 right (the “Extension Right”) to extend the term of this Lease with respect to the entire Premises for 120 months (the “Extension Term”) on the same terms and conditions as this Lease (other than with respect to Base Rent and the Work Letter) by giving Landlord written notice of its election to exercise the Extension Right at least 12 months prior, and no earlier than 18 months prior, to the expiration of the Base Term of this Lease.

Extension Right. Effective as of the date hereof, [Article 17] is deleted in its entirety.

Extension Right. Tenant shall have a one-time right (the “Extension Right”) to extend the term of this Lease for 5 years (the “Extension Term”) on the same terms and conditions as this Lease (other than with respect to Base Rent, which shall be determined as set forth below, and the Work Letter, which shall not be applicable) by giving Landlord written notice of its election to exercise the Extension Right at least 15 months prior (but no earlier than 24 months prior, except as expressly set forth in Section 39(a)) to the expiration of the Base Term of the Lease.

Extension Right. Subject to the superior rights of Nektar Therapeutics, Inc. and subject to the terms of this [Section 39(a)], Tenant shall have 1 right (the “Extension Right”) to extend the term of this Lease for 60 months (the “Extension Term”) on the same terms and conditions as this Lease (other than with respect to Base Rent and the Improvement Allowance) by giving Landlord written notice of its election to exercise the Extension Right at least 9 months prior to the expiration of the Base Term of this Lease.

Patent Right Term Extension. If elections with respect to obtaining patent term extension or supplemental protection certificates or their equivalents in any country in the Territory with respect to any Licensed Product becomes available, upon Regulatory Approval or otherwise, then [[FibroGen:Organization]] will have the sole right to file for patent term extension or supplemental protection certificates or their equivalents and to determine which issued patent to extend. HFB and any of its Affiliates will reasonably cooperate with [[FibroGen:Organization]] so as to enable [[FibroGen:Organization]] to exercise its rights under this [Section 9.8(a)] (Patent Right Term Extension). Such cooperation includes promptly executing all documents, requiring inventors to be available to discuss and review any filings, and requiring inventors, subcontractors, employees, consultants, and agents of HFB or any of its Affiliates to execute all documents, as reasonable and appropriate so as to enable [[FibroGen:Organization]] to exercise its rights under this [Section 9.8(a)] (Patent Right Term Extension).

Extension. The Term of the Existing Sublease is hereby extended through March 15, 2029 (“Extended Expiration Date”), unless sooner terminated in accordance with the terms of the Sublease. That portion of the Term commencing the day immediately following the Prior Expiration Date (“Extension Date”) and ending on the Extended Expiration Date shall be referred to herein as the “Extended Term”. On the Effective Date of this First Amendment, # the defined term “Term” as used in the Existing Sublease shall mean the Term as extended through the Extended Expiration Date and # the defined term “Expiration Date” as used in the Existing Sublease shall mean the Extended Expiration Date.
