Survey. Buyer shall have the right to obtain, at Buyer’s cost and expense, a survey of the Property, together with certification of the surveyor as may be required by Buyer (the “Survey”).

Survey. At Borrower's expense, Lender shall have obtained an updated ALTA Survey of the Property ordered by Lender, dated within 90 days of its use, and prepared by a licensed appraiser satisfactory to Lender, and such appraisal shall be acceptable to Lender in its sole discretion.

Survey. Purchaser shall order, at its sole cost and expense, a current ALTA/NSPS Land Title Survey of the Premises prepared by a Registered Public Surveyor or Professional Engineer (the “Survey”).

Survey. Buyer shall, on before the expiration of the Due Diligence Period, cause an ALTA/NSPS land title survey (the “Survey”) of the Property to be prepared by a professional surveyor registered and licensed in the State of Florida and reasonably acceptable to Seller (the “Surveyor”). The Survey shall depict the Property by metes and bounds description, which description shall be consistent with and accurately describe the area of land depicted in the aerial photograph of the Property attached as Exhibit “A” to the Vacant Land Contract and comprise that portion of the Hendry County Parcel ID Number set forth in Section 1 of the Vacant Land Contract. The Survey shall be certified by the Surveyor to Buyer, Seller, Seller’s counsel and the Title Company and shall otherwise be in a form satisfactory to the Title Company to eliminate the standard survey exceptions from the Title Policy to be issued at Closing. Upon completion of the Survey, Buyer shall furnish Seller with two (2) signed and sealed original prints thereof. Subject to the foregoing provisions, the Survey shall be used as the basis for the preparation of a legal description to be included in the Deed to be delivered by Seller to Buyer at Closing. Buyer shall notify Seller in writing within the time period for Buyer to notify Seller of any Title Defects, specifying any matters shown on the Survey which adversely affect the title to the Property and the same shall be deemed to be Title Defects which shall be dealt with within the same time, manner, and subject to the limitations provided

Survey. Prior to expiration of the Due Diligence Period, Buyer shall have the right to obtain, at its sole cost and expense, a survey (or any updated survey) with respect to the Property prepared by a land surveyor registered and licensed in the State of Florida ("Survey").

Exit Survey. At least five (5) Business Days (and not more than sixty (60) days) prior to the expiration or earlier termination of the term of this Lease, Tenant shall provide Landlord with a facility decommissioning and Hazardous Materials closure plan for the Premises (“Exit Survey”) prepared by an independent third party reasonably acceptable to Landlord but only to the extent such an Exit Survey shall be customarily provided in connection with the turn-over of premises containing any facilities similar to those in the Premises. The Exit Survey shall comply with the American National Standards Institute’s Laboratory Decommissioning guidelines (ANSI/AIHA [[Unknown Identifier]].11-2008) or any successor standards published by ANSI or any successor organization (or, if ANSI and its successors no longer exist, a similar entity publishing similar standards). In addition, at least ten (10) days (and not more than sixty (60) days) prior to the expiration or earlier termination of the term of this Lease, Tenant shall provide Landlord with written evidence of all governmental releases required to be obtained by Tenant as a result of cessation of operations at the Premises in accordance with applicable Environmental Laws. Tenant’s obligations under this Section shall survive the expiration or earlier termination of the Lease.

Survey. A plat of survey (“Survey”) of each Parcel prepared by a registered land surveyor in accordance with the current survey standards of the American Land Title Association and National Society of Professional Surveyors.

A Survey of the Punta Gorda Parcel no older than ninety (90) days, which Survey must be prepared by a registered land surveyor in accordance with the current survey standards of the American Land Title Association and National Society of Professional Surveyors. The Survey shall be certified to Borrower, Administrative Agent and the Title Company. The Survey shall include such information as may be required by the Title Company to provide survey coverage in the Title Policy and shall be satisfactory to Administrative Agent in all material respects.

Exit Survey. At least five (5) Business Days (and not more than sixty (60) days) prior to the expiration or earlier termination of the term of this Lease, Tenant shall provide Landlord with a facility decommissioning and Hazardous Materials closure plan for the Premises (“Exit Survey”) prepared by an independent third party reasonably acceptable to Landlord. In addition, at least ten (10) days (and not more than sixty (60) days) prior to the expiration or earlier termination of the term of this Lease, Tenant shall provide Landlord with written evidence of all appropriate governmental releases obtained by Tenant in accordance with applicable laws, including laws pertaining to the surrender of the Premises. Tenant’s obligations under this Section shall survive the expiration or earlier termination of the Lease.

Survey. Upon the request of the Lenders, the Borrower shall promptly, and in no event later than 45 days following date of such request, deliver or cause to be delivered to the Lenders a Survey, with respect to the real Property listed on [Schedule 5.9(d)].
