Prohibited Transaction” means any transaction described in # [Section 406] of ERISA that is not exempt by reason of [Section 408] of ERISA or by reason of a Department of Labor prohibited transaction individual or class exemption or # Section 4975(c) of the Code that is not exempt by reason of Section 4975(c)(2) or 4975(d) of the Code or by reason of a Department of Labor prohibited transaction individual or class exemption.

Prohibited Transaction” means any transaction described in [section 406] of ERISA which is not exempt by reason of [section 408] of ERISA or the transitional rules set forth in [section 414(c)] of ERISA and any transaction described in section 4975(c) of the Code which is not exempt by reason of [section 4975(c)] (2) or section 4975(d) of the Code, or the transitional rules of [section 2003(c)] of ERISA.
