any involuntary condemnation, seizure or taking, by exercise of the power of eminent domain or otherwise, or confiscation or requisition of use of property,

Liens arising on any real property as a result of any eminent domain, condemnation or similar proceeding being commenced with respect to such real property;

There is no pending or threatened condemnation or eminent domain proceeding with respect to, or that could affect, any of the Real Property of any Company.

any Lien imposed as a result of a taking under the exercise of the power of eminent domain by any governmental body or by any Person acting under governmental authority;

“Casualty Event” means any loss, casualty or other insured damage to, or any nationalization, taking under power of eminent domain or by condemnation or similar proceeding of, any Property of any Loan Party.

Tejon suffers a taking of the Tejon Water by condemnation, eminent domain or other action by any state or federal agency or instrumentality, which renders Tejon permanently unable to perform under this Agreement.
