Permitted Investments. Attached as [Schedule 12.1](kk) is, as of the Closing Date, a true and complete list of all Permitted Investments which have been made.

investments in existence on the date hereof and described in [Schedule 6.04] and extensions or renewals thereof; provided that the amount of the original Investment is not increased except as permitted by this Section 6.04.

Permitted Investments. The Consolidated Group’s activities shall be limited to

Capital Expenditures and Capitalized Software Expenditures; (d)normal trade credit extended in the ordinary course of business and consistent with prudent business practice;

loans or advances made by Holdings to any Subsidiary or by any Subsidiary to Holdings or another Subsidiary; provided that # such loans and advances shall be subordinated to the Obligations to the extent required by Section 6.01(c) and (ii) the amount of such loans and advances made after the 2016 Restatement Date by Loan Parties to Subsidiaries that are not Loan Parties and outstanding at any time shall be subject to the limitation set forth in [clause (a) above];

Investments existing on the date hereof to the extent not otherwise permitted under another clause of this [Section 6.06], as set forth on [Schedule 6.06];

existing investments and advances described on [Schedule 6.04] hereto, but no increase in the amount thereof;

“Person” means any individual, sole proprietorship, partnership, joint venture, trust, unincorporated organization, association, corporation, limited liability company, institution, other entity or government.
