Lease of Premises. Upon and subject to all of the terms and conditions hereof, Landlord hereby leases the Premises to Tenant and Tenant hereby leases the Premises from Landlord. The portions of the Project which are for the non-exclusive use of tenants of the Project, are collectively referred to herein as the “Common Areas.” Tenant shall have the non-exclusive right to use the Common Areas in common with the other tenants in the Project. Landlord reserves the right to modify Common Areas, provided that such modifications do not materially adversely affect Tenant’s use of the Premises for the Permitted Use and provided such modifications do not materially increase the obligations or materially decrease the rights of Tenant under this Lease.

Landlord reserves the right to modify Common Areas, provided that such modifications do not materially adversely affect Tenant’s access to (other than on a temporary basis) or use of the Premises for the Permitted Use or Tenant’s parking rights hereunder (other than on a temporary basis). From and provided such modifications do not materially increaseafter the obligationsCommencement Date through the expiration of the Term, Tenant shall have access to the Building, the Premises and the parking areas serving the Project 24 hours a day, 7 days a week, except in the case of emergencies, as the result of Legal Requirements, the performance by Landlord of any installation, maintenance or materially decreaserepairs, or any other temporary interruptions, and otherwise subject to the rightsterms of Tenant under this Lease.

The portions of the Project which are for the non-exclusive use of tenants of the Project, are collectively referred to herein as the “CommonCommon Areas.” Tenant shall have the non-exclusive right to use the Common Areas in common with the other tenants in the Project.Project, and subject to the rules and regulations referred to in Article 5 of this Lease, those portions of the Project which are provided, from time to time, for use in common by Landlord, Tenant and any other tenants of the Project, which shall include the shipping and receiving area in the Building (such areas, together with such other portions of the Project designated by Landlord, in its discretion, are collectively referred to herein as the "Common Areas"). Landlord shall maintain and operate the Common Areas, including all sprinkler and other systems serving the Common Areas, in a first class manner, and the use thereof shall be subject to such rules, regulations and restrictions as Landlord may reasonably make from time to time. Landlord reserves the right to modifyclose temporarily, make alterations or additions to, or change the location of elements of the Project and the Common Areas, provided that such modifications do not materially adversely affect Tenant’in connection therewith Landlord will use commercially reasonable efforts to minimize any interference with Tenant's use of and access to the Premises for the Permitted Use and provided such modifications do not materially increase the obligations or materially decrease the rights of Tenant under this Lease.parking areas.

The manner in which the Common Areas are maintained and operated shall be at the sole discretion of Landlord (but shall be consistent with the manner materially consistent with reasonably prudent landlords of comparable buildings in the vicinity of the Project) and the use thereof shall be subject to such reasonable, non-discriminatory rules, regulations and restrictions as Landlord may make from time to time. Landlord reserves the right to modifyclose temporarily, make alterations or additions to, or change the location of elements of the Project and the Common Areas, provided thatthat, in connection therewith, Landlord shall perform such modifications do not materially adversely affect Tenant’closures, alterations, additions or changes in a commercially reasonable manner and, in connection therewith, shall use commercially reasonable efforts to minimize any unreasonable interference with Tenant’s use of and access to the Premises forPremises. Except when and where Tenant’s right of access is specifically excluded in this Lease, Tenant shall have the Permitted Useright of access to the Premises, the Building, and provided such modifications do not materially increase the obligations or materially decreaseProject parking facility twenty-four (24) hours per day, seven (7) days per week during the rights of Tenant under this Lease.Lease Term (hereinafter defined).

Lease of Premises. Landlord reserves the right to modify Common Areas, providedmake such changes, additions and/or deletions to the Project and/or the common areas and parking or other facilities thereof as it shall determine from time to time. Tenant acknowledges that such modifications do not materially adversely affect Tenant’sneither Landlord (nor any employee or agent of Landlord) has made any representation or warranty with respect to the suitability or use of the Premises or Project for Tenant’s intended Permitted Use or operations. Landlord shall have no liability to Tenant whatsoever in the event Tenant cannot conduct its Permitted Use and/or intended operations in the Premises and in addition to any other requirements set forth in the Lease, Tenant shall be solely responsible for any and all costs that relate or pertain to alterations necessary or appropriate to make the Premises comply with any codes, regulations, laws or ordinances for such Permitted Use or operations. In addition, Tenant shall provide Landlord with copies of any and all licenses or permits of any kind necessary for it to conduct the Permitted Use at the Premises no later than fifteen (15) days after receipt of the same and provided such modifications do not materially increase the obligations or materially decrease the rights of Tenant under this Lease.upon each subsequent renewal.

Lease of Premises. Thethis Lease, those portions of the Project which are provided, from time to time, for use in common by ​, ​ and any other owners and tenants of the Project (such areas, together with such other portions of the Project designated by ​ or other owners of the Project, in their discretion, including certain areas designated for the non-exclusive use of tenants of the Project,certain tenants, or to be shared by ​, certain owners, and certain tenants, are collectively referred to herein as the “Common Areas.” Tenant shall have the non-exclusive right to use“Common Areas”). The manner in which the Common Areas in common withowned by ​ are maintained and operated shall be at the other tenants inreasonable discretion of ​ (subject to the Project.
