Contractor; GMP. Landlord shall enter into a contract (“Contract”) for the Tenant Improvement Work with B.W. Kennedy & Company, LLC (“Contractor”). The Contract may be on the basis of a guaranteed maximum price (“GMP”). The GMP shall be determined based upon the sum of the following:

Contractor. A contractor selected by Tenant in accordance with the procedures set forth in this Section 4.1_ (“Contractor”) shall construct the Tenant Improvements. Following approval of the Approved Working Drawings, Tenant shall select three (3) qualified, licensed and reputable general contractors from a list of genera} contractors supplied by Landlord (each a “Bidding Contractor,” and, collectively, the “Bidding Contractors”) that shall bid on the construction of the Tenant Improvements on or before a date mutually established by Landlord and Tenant after approval of the Approved Working Drawings. Landlord hereby pre-approves WCI-GC as a Bidding Contractor. Each of the Bidding Contractors shall be notified in the bidding package, which shall be prepared by Landlord and reasonably approved in advance by Tenant, of # the time schedule for construction of the Tenant Improvements, and # the requirement that, unless Landlord otherwise requires, the selected Bidding Contractor shall use the fire, lifesafety subcontractor designated by Landlord. Tenant shall, within two (2) business days following the date upon which Landlord delivers such bids to Tenant, select the Contractor from among the Bidding Contractors that # submitted qualified bids which were consistent with the bid assumptions and directions, and # have committed to the time schedule for construction of the Tenant Improvements approved by Landlord and Tenant.

Contractor. A general contractor shall be retained by Tenant to construct the Tenant Improvements. Such general contractor (the “Contractor”) shall be selected by Tenant, and reasonably approved by Landlord. Tenant shall deliver to Landlord notice of its selection of the Contractor upon such selection.

Contractor; GMP. Landlord shall enter into a contract (“Contract”) for the Tenant Improvement Work with BW Kennedy (“Contractor”). The Contract may be on the basis of a guaranteed maximum price (“GMP”).

Contractor. Tenant shall select not less than three (3) contractors from the list of "Approved Contractors", as that term is defined hereinbelow, to bid on the construction of the Improvements ("Bidding Contractors") Tenant shall select one of the Bidding Contractors to be the contractor for the construction of the Improvements; provided, however, Tenant shall first inform Landlord of, and review with Landlord in reasonable detail the comparison factors identified hereinbelow, 'Tenant's selection and the basis therefor, and such selected Bidding Contractor shall be referred to herein as the "Contractor". Tenant shall select the Contractor in consideration of the following factors: the qualified bid amount (after adjustment for inconsistent qualifications, clarifications and exclusions to reflect an "apples to apples" comparison), the completeness of the bid, contract terms and conditions and such Bidding Contractor's ability and commitment to adhere to 'the construction schedule for the Improvements. "Approved Contractors" shall mean any of the following: a. Bycor; Pacific Building Group (PBG); Commercial Builders Inc (CBI); Diversified Construction Technologies (DCT); Prevost; Johnson & Jennings; Whitting Turner; Burger; Crew Builders; Rudolf and Sletton; and any other contractor that Landlord and Tenant hereafter mutually and reasonably agree be added.

Contractor. A contractor designated by Tenant and reasonably approved by Landlord (“Contractor”) shall construct the Tenant Improvements.

Contractor. Landlord shall retain a contractor of its choice (for purposes of this [Exhibit B], the “Contractor”) to perform the Tenant Improvement Work. In addition, Landlord may select and/or approve of any subcontractors, mechanics and materialmen used in connection with the performance of the Tenant Improvement Work.

Contractor. Landlord shall engage PIDC Construction (the “Contractor”) to perform the Landlord’s First Floor Expansion Premises TI Work. The contract with the Contractor shall be on the basis of a guaranteed maximum price (the “GMP”). The GMP shall be determined based upon the following:
