Continuation of Benefits After the Termination Date contract clause examples

Date of Termination. The date on which a Participant ceases to be an Employee of an Employer within the meaning of Treasury Regulation Section 1.409A-1(h) and which constitutes a “separation from service.”

“Termination Date” shall mean the date of separation from service as an employee within the meaning of [Section 409A(a)(2)(A)(i)] of the Code and Treasury Regulation Section 1.409A-1(h).

Termination Date” means the date on which the Participant experiences a “separation from service” as defined under Code section 409A.

Separation from Service” means the date of cessation of a Participant’s employment or service relationship with the Company or Affiliate determined in accordance with Code Section 409A(a)(2)(A)(i) and Treasury Regulation Section 1.409A-1(h).
