Tenant acknowledges and agrees that it has inspected the Additional Space, is fully familiar with the physical condition thereof and the Building and agrees to accept possession of the Additional Space in its “as-is” condition as of the A.S. Commencement Date, and Landlord shall have no obligation to do any work in or to the Additional Space in order to make it suitable and ready for occupancy and use by Tenant.

Tenant acknowledges that Owner has made no representations to Tenant with respect to the condition of the Additional Space. Tenant further acknowledges and represents to Owner that it has thoroughly inspected and examined, or caused to be thoroughly inspected and examined, the Additional Space and that it is fully familiar with the physical condition and state of repair thereof and Tenant agrees to accept the Additional Space “as-is” in its existing condition and state of repair, subject to any and all defects and materials therein, other than latent, and agrees that, notwithstanding anything to the contrary contained herein or in the Lease, Owner shall have no obligation to alter, improve, decorate or otherwise prepare the Additional Space for Tenant’s occupancy except that Owner shall: # repair the slab opening; # laminate the perimeter walls; and # supply only three (3) fan power boxes.
