Employee shall not text, copy, or otherwise transfer in any form or format Confidential Information to any document, paper, computer, tablet, Blackberry, cellular phone, personal mobile device, Blackberry, iPhone, iPad, thumb drive, smart phone memory, zip drive or disk, flash drive, external drive or any other similar device used for storing or recording data of any kind (the "Devices") unless such Device is issued by the Company to Employee, or unless such text, copy or transfer is expressly approved in writing by the Company before Employee's use of such Device.

Return of the Company Property. Mr. Haak confirms that he has returned to the Company all property of the Company, tangible or intangible, including but not limited to keys, files, records (and copies thereof), and equipment (including, but not limited to, computer hardware, software and printers, wireless handheld devices, cellular phones, tablets, etc.), and that he has left intact all, and has otherwise not destroyed, deleted, or made inaccessible to the Company any, electronic Company documents, including but not limited to those that he developed or helped to develop during his employment. Mr. Haak further confirms that he has canceled all accounts for his benefit, if any, in the Company’s name, including but not limited to, credit cards, cellular phone and/or wireless data accounts and computer accounts. Notwithstanding anything herein to the contrary, Mr. Haak may retain and use his mobile phone number currently linked to the Company’s Verizon account. The Company agrees to use reasonable efforts to allow Mr. Haak to port the foregoing mobile phone number to a carrier and device of his choosing.

Return of Company Property – Executive confirms that, except as Executive has been specifically instructed otherwise by the Company, Executive has returned to the Company all property of the Company, tangible or intangible, including but not limited to keys, files, records (and copies thereof), equipment (including, but not limited to, computer hardware, software and printers, wireless handheld devices, cellular phones, tablets, etc.), Company identification and any other Company-owned property in Executive’s possession or control and that Executive has left intact all electronic Company documents, including but not limited to those that Executive developed or helped to develop during Executive’s employment. This express consent applies to each such telephone number that Borrower provides to Bank now or in the future and permits such calls for non- marketing purposes. Calls and messages may incur access fees from Borrower’s cellular provider.

Such Wireless Communication Equipment shall, in all instances, comply with applicable governmental laws, codes, rules and regulations. Tenant hereby acknowledges and agrees that its use of the Wireless Communication Equipment # shall not be permitted to interfere with any wireless communication equipment or other equipment of any other occupant of the Project, # shall not be permitted to interfere with any wireless communication equipment or other equipment of any other third-party with whom Landlord has any third-party agreement, and # shall not be permitted to interfere with Landlord’s Communication Equipment. Landlord shall use commercially reasonable efforts to ensure that Landlord’s Communication Equipment does not interfere with Tenant’s Wireless Communication Equipment; provided, however, Tenant hereby acknowledges and agrees that Landlord has made no warranty or representation to Tenant with respect to the suitability of the Premises for any wireless communications, specifically including, without limitation, with respect to the quality and clarity of any receptions and transmissions to or from the Wireless Communication Equipment and the presence of any interference with such signals whether emanating from Landlord’s Communication Equipment, the Project or otherwise. In no event shall any such interfere with Tenant’s Wireless Communication Equipment have any effect on this Lease or give to Tenant any offset or defense to the full and timely performance of its obligations hereunder, or entitle Tenant to any abatement of rent or additional rent or any other payment required to be made by Tenant hereunder, or constitute any accrual or constructive eviction of Tenant, or otherwise give rise to any other claim of any nature against Landlord.

The Tenant may choose to have a wireless intercom device via a suite specific Wireless Access Point (WAP). This will require the installation of a Base Building network connected (WAP) in the Tenant suite at the cost of the Tenant. The master intercom station software application shall run on Apple-iPad devices provided by Property Management at an additional cost to the Tenant. The wireless intercom device is functional within the constraints of the wireless communication signal area provided through the WAP. Please note, that due to the WAP being on the Base Building security network, the iPad device connection parameters will be configured directly by the Property Management over the secure WAP. The intercom application will be the only application allowed to run on the iPad device.
