any other claims that cannot lawfully be released; # Employee’s ability to communicate with the Equal Employment Opportunity Commission or any other governmental agency, as long as Employee does not seek any personal relief for any claims released herein; or # any claims arising after the date of Employee’s execution of this Supplemental Release.

No Transfer of Potential Claims. Seller represents and warrants to Buyer and the other Buyer Released Parties that it has not conveyed, pledged, transferred, hypothecated, or in any manner encumbered or assigned, to any other Person any of the Potential Claims for any Buyer Released Matter.

The ADEA claims being waived, released and discharged in Paragraph 4 do not include any claims that may arise after the date Executive signs this Agreement;

Employee hereby releases Released Parties from any and all claims, whether sounding in contract, tort, statute or constitution, and covenants not to sue Released Parties for any and all claims. Employee understands this Release includes all claims related in any manner to Employee's employment or the cessation of that employment. Employee further understands that Employee is hereby releasing any known or unknown claim for or alleged right to discovery of information or documents of Released Parties.

I represent and warrant that, other than the Excluded Claims, I am not aware of any claims that I have or might have against any of the Released Parties that are not included in the Released Claims. Nothing in this Agreement prevents me from discussing or disclosing information about unlawful acts in the workplace, such as harassment or discrimination or any other conduct that I have reason to believe is unlawful.

In addition to the release contained in [Section 5(c)] above, and not in limitation thereof, the Loan Parties do hereby agree that they will never prosecute, nor voluntarily aid in the prosecution of, any action or proceeding relating to the Released Claims, whether by claim, counterclaim or otherwise. If, and to the extent that, any of the Released Claims are, for any reason whatsoever, not fully, finally and forever released and discharged pursuant to the terms of [Section 5(c)] above, the Loan Parties do hereby absolutely and unconditionally grant, sell, bargain, transfer, assign and convey to Agent all of the Released Claims and any proceeds, settlements and distributions relating thereto.

Assurance. You warrant and represent that you have not filed any claims, charges or lawsuits against any Released Party.

That he is intentionally releasing claims that he did not know that he might have and that, with hindsight, he might regret having released. He has not assigned or given away any of the claims he is releasing.

Executive also agrees that he has not assigned to anyone any of the claims released and forever discharged in this Agreement.

11.13Plaintiffs represent and warrant that they have not assigned any claim or right or interest relating to any of the Released Claims against the Released Parties to any other person or party and that they are fully entitled to release the same.
