Waiver of Jury Trial. Maker hereby knowingly, voluntarily, intentionally, unconditionally and irrevocably waives any and all right to trial by jury in any action, suit, counterclaim or cross claim arising out of, or in connection with this Note or any course of conduct, course of dealing, statements (whether oral or written) or actions of Holder with respect to this Note. Maker agrees that it has received sufficient consideration for their waiver hereunder, and understands that any such action shall be tried by a judge without a jury.

WAIVER OF RIGHT TO TRIAL BY JURY. Borrower hereby unconditionally and irrevocably waives any and all right to trial by jury in any action, suit, counterclaim or cross-claim arising in connection with, out of or otherwise relating to this Note or any other loan or security instrument, or any transaction arising therefrom or related thereto.

Jury Trial Waiver. Holder and the Company each hereby waive any right to trial by jury of any claim (including crossclaims and counterclaims) it may have against each other under, in connection with, or related to this Note or the Note Purchase Agreement.
