This Agreement shall be binding upon and inure to the benefit of the successors and assigns of BD and shall be binding upon and inure to the benefit of the successors and assigns of Consultant.

Successors and Assigns. This Agreement shall be binding upon the [[MHR Entities:Organization]] and their respective successors and assigns.

Binding Effect and Benefit. This Certificate shall be binding upon and, subject to the terms and conditions hereof, inure to the benefit of the Company, its successors and assigns, and You and Your successors and assigns.

Successors. This Award Agreement, including but not limited to the non-competition obligations described in Section 16 below, shall be binding upon and inure to the benefit of any successor or successors of the Corporation.

Successors. This Agreement shall inure to the benefit of the parties hereto and their respective successors and assigns as permitted by the terms of Credit Agreement.

Successors. All obligations of the Company under the Plan with respect to Awards granted hereunder shall be binding on any successor to the Company, whether the existence of such successor is the result of a direct or indirect purchase, merger, consolidation, or otherwise, of all or substantially all of the business and/or assets of the Company.

Successors. This Agreement will inure to the benefit of and be binding upon the parties hereto, and to the benefit of the employees, officers and directors and controlling persons referred to in Section 6, and in each case their respective successors, and no other person will have any right or obligation hereunder. The term “successors” shall not include any purchaser of the Shares as such from the Agent, or purchaser of Forward Hedge Shares from the Forward Purchaser, merely by reason of such purchase.

Successors. Except as provided in [Section 7.6(a)], all of the terms and provisions of this Agreement shall be binding upon, and shall inure to the benefit of and be enforceable by, the Parties and their respective successors, permitted assigns, heirs, executors, administrators and legal representatives. The Corporation shall require and cause any direct or indirect successor (whether by purchase, merger, consolidation or otherwise) to all or substantially all of the business or assets of the Corporation, by written agreement, expressly to assume and agree to perform this Agreement in the same manner and to the same extent that the Corporation would be required to perform if no such succession had taken place.

Successors. This Award shall be binding upon and inure to the benefit of the heirs, legal representatives, successors, and permitted assigns of the parties.

Successors. The terms and provisions of this Deed of Trust, and the rights and obligations of Trustor, Trustee and Beneficiary, shall inure to the benefit of and be binding upon Trustor, Trustee and Beneficiary, and their successors and assigns. All references to the term “beneficiary” herein shall mean the owner and holder of the Notes, whether or not named as beneficiary herein.
