Attorneys’ Fees. In the event of litigation arising under this Agreement or out of or concerning the Executive’s employment or termination by the Company, the prevailing party shall, in addition to all costs of suit, be entitled to recover its or his reasonable attorneys’ fees from the other party.

ATTORNEYS’ FEES. The Company shall reimburse Executive for the reasonable attorneys’ fees incurred by him relating to the negotiation and documentation of this Agreement and any related agreements, subject to a maximum of $15,000.

Attorneys’ Fees. In any court action at law or equity that is brought by one of the Parties to this Agreement to enforce or interpret the provisions of this Agreement, the prevailing Party will be entitled to reasonable attorneys’ fees, in addition to any other relief to which that Party may be entitled.

Attorneys’ Fees. If either party hereto brings an action or other proceeding against the other to enforce, protect, or establish any right or remedy created under or arising out of this Sublease, the prevailing party shall be entitled to recover from the other party, all costs, fees and expenses, including, without limitation, attorneys’ fees, expenses, and disbursements incurred or sustained by such prevailing party in connection with such action or proceeding, and the prevailing party’s rights to recover its costs, fees and expenses, and any award thereof, shall be separate from, shall survive, and shall not be merged with any judgment.

Attorneys' Fees. In the event that either Landlord or Tenant should bring suit for the possession of the Premises, for the recovery of any sum due under this Lease, or because of the breach of any provision of this Lease or for any other relief against the other, then all costs and expenses, including reasonable attorneys' fees, incurred by the prevailing Party therein shall be paid to the prevailing Party by the other Party, which obligation on the part of the other Party shall be deemed to have accrued on the date of the commencement of such action and shall be enforceable whether or not the action is prosecuted to judgment.

Attorneys’ Fees. The provisions of the Lease respecting payment of attorneys’ fees shall also apply to this Amendment.

Attorneys’ Fees. In the event of any dispute between the parties concerning the terms and provisions of this Warrant, the party prevailing in such dispute shall be entitled to collect from the other party all costs incurred in such dispute, including reasonable attorneys’ fees.

Attorneys’ Fees. If any party is required to engage the services of an attorney for the purpose of enforcing this Note, or any provision hereof, the prevailing party shall be entitled to recover its reasonable and documented expenses and costs in enforcing this Note, including attorneys’ fees.

Attorneys’ Fees. If any party hereto defaults in any manner or fails to fulfill any and all provisions of this Assignment, and if the nondefaulting party places this Assignment with an attorney to exercise any of the rights of the nondefaulting party upon such default or failure, or if suit be instituted or defended by the nondefaulting party by reason of, under or pertaining to such default or failure, then the nondefaulting party shall recover reasonable attorneys’ fees actually incurred, costs and expenses from the defaulting party. This Section shall be enforceable by the parties hereto notwithstanding any rescission, forfeiture, or other termination of this Assignment.

Attorneys’ Fees. The Bank shall pay the Executive’s attorney $35,000 with respect to the attorneys’ fees incurred by the Executive in connection with the negotiation of this Amendment. Such fees will be paid directly to Executive’s attorney within 5 business days of the Effective Date.
