Attorneys’ Fees. In the event that suit be brought hereon, or an attorney be employed or expenses be incurred to compel payment of this Note or any portion of the indebtedness evidenced hereby, or to enforce any rights or remedies of Holder under this Note in accordance therewith, Maker promises to pay all such attorney’s fees, costs and expenses of investigation as actually incurred by Holder as a result thereof and including, without limitation, attorneys’ fees, costs and expenses of investigation incurred in appellate proceedings or in any action or participation in, or in connection with, any case or proceeding under Chapters 7, 11 or 13 of the United States Bankruptcy Code or any successor thereto.

Costs of Collection. Should the event that suitindebtedness represented by this Note, or any part hereof, be brought hereon,collected at law, in equity, or an attorney be employedin any bankruptcy, receivership or expenses be incurred to compel payment ofother court proceeding, or this Note orbe placed in the hands of any portion ofattorney for collection after default, Maker agrees to pay, in addition to the indebtedness evidenced hereby, or to enforce any rights or remedies of Holder under this Note in accordance therewith, Maker promises to payprincipal and interest due hereon, all such attorney’sreasonable attorneys’ fees, plus all other costs and expenses of investigation as actually incurred by Holder as a result thereofcollection and including, without limitation, attorneys’ fees, costs and expenses of investigationenforcement, including any fees incurred in appellateconnection with such proceedings or in any action or participation in, or in connection with, any case or proceeding under Chapters 7, 11 or 13collection of the United States Bankruptcy Code Note and/or any successor thereto.enforcement of Holder’s rights.

EXPENSES. In the event that suit be brought hereon, or an attorney be employed or expenses be incurred to compelany payment of this Note or any portion of the indebtedness evidenced hereby, or to enforce any rights or remedies of Holder under this Note is not paid when due, the Maker agrees to pay, in accordance therewith, Maker promisesaddition to paythe principal and interest hereunder, reasonable attorneys' fees plus all such attorney’s fees, costs andother reasonable expenses of investigation as actually incurred by Payee or Holder as a result thereofin exercising any of its rights and including, without limitation, attorneys’ fees, costs and expenses of investigation incurred in appellate proceedings or in any action or participation in, or in connection with, any case or proceeding under Chapters 7, 11 or 13 of the United States Bankruptcy Code or any successor thereto.remedies upon default.
