Part 302 and amendments thereto); or by similar applicable Environmental Law in Canada or by a Canadian Governmental Authority; and # any substance, material, or waste that is petroleum, petroleum-related, or a petroleum by-product, asbestos or asbestos-containing material, polychlorinated biphenyls, flammable, explosive, radioactive, freon gas, radon, or a pesticide, herbicide, or any other agricultural chemical.chemical regulated under the Federal Insecticide, Fungicide and Rodentide Act (“FIFRA”), 7 U.S.C. § 136 et seq. or similar applicable Environmental Law in Canada.

Hazardous Materialsmeans:means # any substance, material,material or waste that issubstance defined as or included withinin the definitionsdefinition of “hazardous substances,” “hazardous materials,wastes,” “hazardous waste,” “toxic substances,” “toxic materials,” “toxic waste,” or words of similar import in any Environmental Law; # those substances listed as hazardous substances by the United States Department of Transportation (or any successor agency) (49 C.F.R. 172.101 and amendments thereto) or by the Environmental Protection Agency (or any successor agency) (40 C.F.R. Part 302 and amendments thereto); and # any substance, material, or waste that is petroleum, petroleum-related, or a petroleum by-product, asbestos or asbestos-containing material, polychlorinated biphenyls, flammable, explosive, radioactive, freon gas, radon, or a pesticide, herbicide,substances” or any other agricultural chemical.formulations intended to define, list or classify substances by reason of their deleterious properties, # any oil, petroleum or petroleum derived substance, # any flammable substances or explosives, # any radioactive materials, # asbestos in any form, # electrical equipment that contains any oil or dielectric fluid containing levels of polychlorinated biphenyls in excess of fifty parts per million, # pesticides or # any other chemical, material or substance, exposure to which is prohibited, limited or regulated by any governmental agency or authority or which may or could pose a hazard to the health and safety of persons in the vicinity thereof.

Hazardous Materialsmeans:means # any substance, material, or waste that is included within the definitions of “hazardous substances,substance,“hazardous materials,“pollutant,” “contaminant,” “hazardous waste,” “regulated substance,” “hazardous chemical” or “toxic substances,” “toxic materials,” “toxic waste,”chemical” as designated, listed or words of similar importdefined (whether expressly or by reference) in any Environmental Law; # those substances listed asany other pollutant, chemical, substance, toxic, infectious, carcinogenic, reactive, corrosive, ignitable or flammable chemical, or chemical compound, or hazardous substances by the United States Departmentsubstance, material or waste, whether solid, liquid or gas, that is subject to regulation, control or remediation under any Environmental Laws, including any quantity of Transportation (orasbestos in any successor agency) (49 C.F.R. 172.101 and amendments thereto)form, urea, formaldehyde, polychlorinated biphenyls (PCBs), radon gas, petroleum, waste oil, crude oil, or by the Environmental Protection Agency (or any successor agency) (40 C.F.R. Part 302 and amendments thereto);fraction thereof, all forms of natural gas, petroleum products or by-products or derivatives, and # any substance, material,compound, mixture, solution, product or wasteother substance or material that is petroleum, petroleum-related,contains any hazardous substance or a petroleum by-product, asbestos or asbestos-containing material, polychlorinated biphenyls, flammable, explosive, radioactive, freon gas, radon, or a pesticide, herbicide, or any other agricultural chemical.material referred to in [clause [(a) and (b) above]e]].

Hazardous Materialsmeans:shall mean # any material, substance, material,chemical, waste, product, derivative, compound, mixture, solid, liquid, mineral, or wastegas, in each case, whether naturally occurring or manmade, that is included within the definitions of “hazardous substances,” “hazardous materials,” “hazardous waste,” “toxic substances,” “toxic materials,” “toxic waste,”hazardous, acutely hazardous, toxic, or words of similar import in anyor regulatory effect under Environmental Law; # those substances listed as hazardous substances by the United States Department of Transportation (or any successor agency) (49 C.F.R. 172.101 and amendments thereto) or by the Environmental Protection Agency (or any successor agency) (40 C.F.R. Part 302 and amendments thereto);Laws; and # any substance, material,petroleum or waste that is petroleum, petroleum-related,derived products, radon, radioactive materials or a petroleum by-product,wastes, asbestos in any form, lead, or asbestos-lead-containing material,materials, urea formaldehyde foam insulation, and polychlorinated biphenyls, flammable, explosive, radioactive, freon gas, radon, or a pesticide, herbicide, or any other agricultural chemical.biphenyls.
