Pricing. As between the Parties, Tracon shall have the sole right to make all decisions regarding the pricing of the Collaborative Product in the Field in the Collaborative Territory; provided that, if Tracon sells the Collaborative Product in a “bundle” with one or more other products or services at a discount to the purchaser, then Tracon shall not disproportionately or unreasonably discount such Collaborative Product relative to the other products or services composing such bundle. PRICING. Service Provider shall not under any circumstances bill PARATEK on an actual cost‑plus‑percentage‑of‑cost basis. Notwithstanding Service Provider’s standard pricing and billing practices, Service Provider shall also not charge PARATEK any premium for overtime. Service Provider shall ensure that no individual salary that exceeds the cap identified in HHSAR 352.231‑70 is charged to PARATEK or used by Service Provider to price services provided under this Agreement.

Pricing. Notwithstanding any other provision of this Agreement, EyePoint shall have sole decision-making authority with respect to the price of any Product. Further, for purposes of clarity and the avoidance of doubt, without the express written consent of EyePoint, which EyePoint may withhold, condition or refuse in its sole and absolute discretion, at no time shall Imprimis or its Affiliates, representatives or agents, promote, create or establish bundled offerings or package deals for the Product in combination with any other product or service.

Pricing. Licensee shall have the sole right and responsibility to set the price of Licensed Products, including in Combination Use. ​. Pricing. Following the CGB discussion and processes, Licensee shall keep Ovid timely informed on the status of any application for Pricing and Reimbursement Approval or material updates to an existing Pricing and Reimbursement Approval in the Licensee Territory, including any discussion with a Regulatory Authority with respect thereto. Licensee and its Affiliates and Sublicensees shall ​ include a Product, ​ of the Product ​ and the Product ​.

Pricing. Following the CGB discussion and processes, Licensee shall keep Ovid timely informed on the status of any application for Pricing and Reimbursement Approval or material updates to an existing Pricing and Reimbursement Approval in the Licensee Territory, including any discussion with a Regulatory Authority with respect thereto. Licensee and its Affiliates and Sublicensees shall ​ include a Product, ​ of the Product ​ and the Product ​.

Pricing. The JCC will establish a global pricing strategy for each Product (including list price, targeted net pricing, sales-weighted average discounts and rebates, the approach to pricing with different types of accounts and plans, types of discounts and rebates) in the Territory. The responsibility for implementation of such global pricing strategy, including negotiating pricing and reimbursement with governments and private payers will be determined by the Lead Commercialization Party.

PRICING. The definition of "LIBOR Margin" appearing in [Exhibit A] of the Loan Agreement is hereby amended in its entirety to read as follows:

Pricing. The pricing for Cannabis Ingredients supplied by Company in accordance with Section 10.1 shall be the fair market value of such Cannabis Ingredients at the time of sale.
