Servicing the Loan and the Servicer. Lender is granted the right to appoint a Person to assist Lender in servicing the Loan (the “Servicer”) at any time with written notice thereof to Borrower. Upon such appointment, the Servicer shall have full authority to act on Lender’s behalf on all matters applicable to the Loan, the Borrower, the Guarantor, the Collateral and the Project, including, without limitation, the following:

Servicing of the Loan. The parties agree that the Participation 1 Holder (or the Servicer) shall service the Loan on behalf of the Participants.

The defined term “Prime Commercial Rate” set forth in Section 1.01 of the Loan Agreement is hereby amended by inserting the following sentence at the end of such defined term:

Co-Borrowers and Lenders hereby agree that the definition of “Maturity Date” appearing in [Section 1.1] of the Loan Agreement is hereby deleted in its entirety and is replaced with the following:

Amendments to Loan Agreement. Effective as of the Third Amendment Effective Date, the Loan Agreement is hereby amended as follows:

The defined term “Revolving Availability Termination Date” set forth in Section 1.01 of the Loan Agreement is hereby amended by deleting the words “August 16, 2019” and inserting the words “August 6, 2020” in their stead.
