ADEA Waiver contract clause examples

ADEA Waiver. You acknowledge that you are knowingly and voluntarily waiving and releasing any rights you may have under the ADEA (the “ADEA Waiver”), and that the consideration given for the ADEA Waiver is in addition to anything of value to which you are already entitled. You further acknowledge that you have been advised by this Agreement, as required by the ADEA, that: # your ADEA Waiver does not apply to any rights or claims that may arise after the date that you sign this Agreement; # you should consult with an attorney prior to signing this Agreement (although you may choose voluntarily not to do so); # you have twenty-one (21) days to consider this Agreement (although you may choose voluntarily to sign it earlier); # you have seven (7) days following the date you sign this Agreement to revoke it (by providing written notice of your revocation to me within the seven-day period); and # this Agreement will not be effective until the date upon which the revocation period has expired unexercised, which will be the eighth day after you sign it.

ADEA Waiver. Executive acknowledges that Executive is knowingly and voluntarily waiving and releasing any rights Executive may have under the ADEA, and that the consideration given for the waiver and release in the preceding paragraph is in addition to anything of value to which Executive is already entitled. Executive further acknowledges that Executive has been advised by this writing that: # Executive’s waiver and release do not apply to any rights or claims that may arise after the date Executive signs this Release; # Executive should consult with an attorney prior to signing this Release (although Executive may choose voluntarily not to do so); # Executive has twenty-one (21) days to consider this Release (although Executive may choose voluntarily to sign it earlier); # Executive has seven (7) days following the date Executive signs this Release to revoke it by providing written notice of revocation [[Organization A:Organization]]’s Chief Executive Officer; and # this Release will not be effective until the date upon which the revocation period has expired, which will be the eighth calendar day after the date Executive signs it provided that Executive does not revoke it (the “Effective Date”).

ADEA Waiver. You acknowledge that you are knowingly and voluntarily waiving and releasing any rights you have under the ADEA, and that the consideration given for the waiver and releases you have given in this Agreement is in addition to anything of value to which you were already entitled. You further acknowledge that you have been advised, as required by the ADEA, that: # your waiver and release does not apply to any rights or claims that arise after the date you sign this Agreement; # you should consult with an attorney prior to signing this Agreement (although you may choose voluntarily not to do so); # you have twenty-one (21) days to consider this Agreement (although you may choose voluntarily to sign it sooner); # you have seven (7) days following the date you sign this Agreement to revoke this Agreement (in a written revocation sent to me); and # this Agreement will not be effective until the date upon which the revocation period has expired, which will be the eighth day after you sign this Agreement provided that you do not revoke it (the “Effective Date”).

ADEA Waiver. You acknowledge that you are knowingly and voluntarily waiving and releasing any rights you may have under the ADEA (“ADEA Waiver”) and that the consideration given for the ADEA Waiver is in addition to anything of value to which you are already entitled. You further acknowledge that: # your ADEA Waiver does not apply to any claims that may arise after you sign this Agreement; # you should consult with an attorney prior to executing this Agreement; # you have at least 21 calendar days within which to consider this Agreement (although you may choose to execute Agreement earlier); # you have 7 calendar days following the execution of the Agreement to revoke this Agreement; and # the Agreement will not be effective until the eighth day after you sign this Agreement provided that you have not revoked it (the “Effective Date”). You agree that any modifications, material or otherwise, made to this Agreement do not restart or affect in any manner the original 21-day consideration period provided in this paragraph. To revoke the Agreement, you must email to [[Person B:Person]] a written notice of revocation at [[Email]], prior to the end of the 7-day period. You acknowledge that your consent to this Agreement is knowing and voluntary. The severance offer will be automatically withdrawn if you do not sign the Agreement within the 21-day consideration period.

ADEA Waiver. You acknowledge that you are knowingly and voluntarily waiving and releasing any rights you may have under the ADEA (the “ADEA Waiver”), and that the consideration given for this ADEA Waiver is in addition to anything of value to which you are already entitled. You further acknowledge that you have been advised, as required by the ADEA, that: # your ADEA Waiver does not apply to any rights or claims that may arise after the date that you sign this Agreement; # you should consult with an attorney prior to signing this Agreement; # you have 21 calendar days to consider this Agreement (although you may choose voluntarily to sign it earlier, but no earlier than the Separation Date); # you have seven calendar days following the date you sign this Agreement to revoke your acceptance (by providing written notice of your revocation to [[Person A:Person]], the Company’s President and Chief Executive Officer); and # this Agreement will not be effective until the date upon which the revocation period has expired unexercised, which will be the eighth calendar day after the date that this Agreement is signed by you provided that you do not revoke your acceptance (the “Effective Date”).

ADEA Waiver. Individual expressly acknowledges and agrees that by entering into this Agreement, he is waiving any and all rights or claims that he may have arising under the Age Discrimination in Employment Act of 1967, as amended (the “ADEA”), and that this waiver and release is knowing and voluntary. Individual and the Company agree that this waiver and release does not apply to any rights or claims that may arise under the ADEA after the date Individual signs this Agreement. Individual further expressly acknowledges and agrees that:

Nevertheless, your general release of claims, except for the ADEA Waiver, is effective immediately, and not revocable.

ADEA Waiver. The Employee acknowledges that the Employee is knowingly and voluntarily waiving and releasing any rights the Employee may now have or have had under the Age Discrimination and Employment Act (“ADEA”), as amended. The Employee also acknowledges that the consideration given for the waiver and release herein is in addition to anything of value to which the Employee was already entitled. The Employee further acknowledges that the Employee has been advised by this writing, as required by the ADEA, that: # the Employee’s waiver and release does not apply to any rights or claims that may arise after the Employee’s execution of this Agreement; # the Employee has the right to consult with an attorney prior to executing this Agreement; # the Employee has twenty one (21) days from the date of this Agreement to execute this Agreement (though the Employee is free to execute this Agreement before the twenty first (21st) day); # the Employee has seven (7) days following the Employee’s execution of this Agreement to revoke the Agreement, provided the Employee has sent a letter to ​ stating that the Employee is revoking it no later than 5 p.m. PST by the seventh (7th) day; # this Agreement will not be effective until the date upon which the revocation period has expired, which will be the eighth day after this Agreement is executed by the Employee, provided that the Company has also executed this Agreement by that date (“Effective Date”); and # this Agreement does not affect the Employee’s ability to test the knowing and voluntary nature of this Agreement.

ADEA Waiver. You acknowledge that you are knowingly and voluntarily waiving and releasing any rights you have under the ADEA, and that the consideration given for the waiver and releases you have given in this Agreement is in addition to anything of value to which you were already entitled. You further acknowledge that you have been advised, as required by the ADEA, that: # your waiver and release does not apply to any rights or claims that arise after the date you sign this Agreement; # you should consult with an attorney prior to signing this Agreement (although you may choose voluntarily not to do so); # you have twenty-one (21) days to consider this Agreement (although you may choose voluntarily to sign it sooner); # you have seven (7) days following the date you sign this Agreement to revoke it (in a written revocation sent to me); and # this Agreement will not be effective until the date upon which the revocation period expires without such revocation, which will be the eighth day after you sign this Agreement provided that you do not revoke it (the “Effective Date”).
