Defined Terms. Capitalized terms that are used in this Agreement have the meaning set forth in the License and Supply Agreement, unless otherwise defined in this Agreement.

Defined Terms. For purposes of this Section, the term “Lender” includes any Issuing Bank and the term “applicable law” includes FATCA.

Terms; Captions. The words " XE "Landlord" Landlord" and " XE "Tenant" Tenant" as used herein shall include the plural as well as the singular. The necessary grammatical changes required to make the provisions hereof apply either to corporations or partnerships or individuals, men or women, as the case may require, shall in all cases be assumed as though in each case fully expressed. The captions of Articles and Sections are for convenience only and shall not be deemed to limit, construe, affect or alter the meaning of such Articles and Sections.

Defined Terms. Unless otherwise noted, capitalized terms used in this Appendix A shall have the same meanings ascribed to them in the Plan.

Defined Terms. Capitalized terms used herein but not defined herein shall have the meanings assigned to such terms in the Amended Credit Agreement (as defined below).

Additional Terms. This Agreement may be extended beyond the Initial Term upon the mutual consent and agreement of Employee and Employer. The Initial Term and additional terms, if any, shall collectively be referred to herein as the “Employment Period”.

Defined Terms. Any capitalized terms utilized in this Second Amendment and which are not separately defined herein shall have the meaning ascribed thereto in the Agreement.

General Terms. In addition to paying the Base Rent specified in Article 3 of this Lease, ​ shall pay “​’s Share” of the annual “Direct Expenses,” as those terms are defined in Sections 4.2.6 and 4.2.22] of this Lease. Such payments by ​, together with any and all other amounts payable by ​ to ​ pursuant to the terms of this Lease, are hereinafter collectively referred to as the “Additional Rent,” and the Base Rent and the Additional Rent are herein collectively referred to as “Rent.” All amounts due under this Article 4 as Additional Rent shall be payable for the same periods and in the same manner as the Base Rent. Without limitation on other obligations of the parties which survive the expiration of the Lease Term, the obligations of ​ to pay the Additional Rent provided for in this Article 4 and the obligation of ​ to reconcile and reimburse ​ for overpayments of Additional Rent shall survive the expiration of the Lease Term.

Defined Terms. For purposes of this Agreement, the definitions of terms contained in the Plan hereby are incorporated by reference, except to the extent that any such term is specifically defined in this Agreement.
