Fire Stairs. Tenant shall have the right to use the internal fire stairway between the contiguous floors of the Premises (it being agreed that Tenant shall be permitted to use the fire stairway between non-contiguous floors of the Premises to the extent that such non-contiguous portion of the Premises shall be added thereto pursuant to any right of first offer or expansion option provided for in this Lease). Tenant, at Tenant’s sole cost and subject to Landlord’s approval of specifications, which approval shall not be unreasonably withheld, conditioned or delayed, shall install its electronic card access system at entry points between such fire stairway and the Premises. Any other alterations to the fire stairways serving the Premises shall be at Tenant’s sole cost and subject to Landlord’s approval, which approval shall not be unreasonably withheld, conditioned or delayed.

Fire Stairs. Landlord consents to the use of the Building fire stairs, subject to and in accordance with [Section 31.3(h)] of the Original Lease, by Tenant for travel only by Tenant’s employees between the ninth (9th) through fifteenth (15th) floors of the Building, so long as Tenant occupies the entirety of said floors.

Fire Stairs. Landlord consents to the use of the Building fire stairs, subject to and in accordance with [Section 31.3(h)] of the Original Lease, by Tenant for travel only by Tenant’s employees between the eighth (8th) and ninth (9th) floors of the Building, so long as Tenant occupies the entirety of said floors. In addition, notwithstanding anything to the contrary contained in [Section 31.3(h)] of the Original Lease, Landlord consents to the use of the Building fire Stairs from the eighth (8th) and ninth (9th) floors of the Building to the eleventh (11th) through fifteenth (15th) floors of the Building, so long as Tenant occupies the entirety of said floors. However, even though the foregoing consent grants Tenant the right to use the Building fire stairs between two (2) non-adjacent floors of the Premises, Tenant’s use of the Building fire stairs shall be subject to all other provisions of [Section 31(h)] of the Original Lease. The foregoing shall not be deemed to amend or modify Tenant’s ability to use such Building fire stairs with respect to the adjoining floors of the Original Premises (which, as of the date of this Amendment, include the eleventh (11th), twelfth (12), thirteenth (13th), fourteenth (14th) and fifteenth (15th) floors of the Building), subject to and in accordance with the terms and conditions of [Section 31.3(h)] of the Original Lease.

Stair shafts will be constructed with metal stud framing and drywall assembly with fire rating in compliance to construction type. Stairs to be 1’ wider than Code required. All interior walls facing the egress stairs will be taped, finished, and painted. Gypsum board ceiling will be constructed at the top level. No soffit on the underside of stairs. Stair rails and stringers will be painted. All associated lighting and fire sprinklers are included.

Ability to use fire stairs to travel to and from the street level and between each Tenant floor. Use of stairs subject to coordination with Landlord’s completion of finishes and inspections of the stairs. Tenant acknowledges that, from time to time, it may be necessary for one (1) of the two (2) core stairwells to be closed (i.e., cannot be used by or on behalf of Tenant) in order to complete finishing of the Base Building Improvements by Landlord’s Contractor. Unfinished stairs or temporary stairwells will be set up for access for all trades.

The right to use or pass along the fire escape passages or routes or stairs in any part of the Building, the Estate and / or Basement in case of emergency.

Public stairwells and paths of egress as required by code. Fire stairs shall be delivered with gypsum wallboard, taped and spackled. Stair walls, railings and runners shall be delivered painted.

Sprinkler heads to be semi-recessed chrome. Center in ceiling tile.

A complete, unpainted, automatic fire protection sprinkler system for light hazard protection will be provided for the building in accordance with the written requirements of the Fire Marshall, NFPA and other applicable codes. All piping, standpipes, valves and specialties will be provided for a complete system to meet code compliance in shell condition. The sprinkler system will contain a flow alarm connected to a fire alarm panel for remote alarm monitoring.

FIRE INSURANCE. LESSEE parties shall not permit any use of the premises which will adversely affect or make voidable any insurance on the property, or the contents of the building, or which shall be contrary to any taw, regulation, or recommendation made by the Insurance Services Office (or successor organization), state fire prevention agency, local fire department LESSOR’S insurer, or any similar entity. LESSEE shall not vacate the premises or permit same to be unoccupied other than during LESSEES customary nonbusiness days or hours, or cause or allow the utilities serving the premises to be terminated.
