“Combination Product”. Combination Product means # any pharmaceutical product that is a single formulation consisting of a Licensed Product and one or more other active compounds or active ingredients or # any combination of a Licensed Product sold together with other separately formulated active compounds or active ingredients for a single invoiced price.

“Combination Product” means: # a single pharmaceutical formulation containing as its Active Ingredients # one or more Licensed Constructs, and # one or more Active Ingredients other than a Licensed Construct; or # a bundle of products comprised of # one or more single pharmaceutical formulations comprising at least one Licensed Construct, and # one or more other therapeutically effective or Prophylactically Active Products, priced and sold in a single package containing such multiple products or packaged separately but sold together for a single price; in each of the [foregoing (a) or (b)])], in all dosage forms, formulations, presentations, line extensions and package configurations thereof.
As used herein, “Combination Product” means a LICENSED PRODUCT that comprises or contains both # a compound which is covered by or is produced using LICENSED SUBJECT MATTER as an active pharmaceutical ingredient; plus # one or more other active pharmaceutical ingredients that is not described in the [foregoing clause (1)], and that is sold either as a fixed dose or as separate doses in a single package for a single price.”

For clarity, drug delivery vehicles, adjuvants and excipients are hereby deemed not to be “therapeutically active pharmaceutical ingredients,” and their presence in itself shall not be deemed to create a Combination Product.
“Combination Product” means any Licensed Product comprised of the following, either formulated together (i.e., a fixed dose combination), packaged together and sold for a single price, or co-administered or jointly provided to patients, whether or not packaged together: # the Compound, and # at least one other API.
